No, your right, but many private businesses will defacto choose to follow federal guidelines especially to prevent litigation issues. I don't know where this specific event occurred but if it is anything like texas then management gets to decide and it's weird that the manager was sitting there being sympathetic instead of trespassing the aggressor in this instance.
