One Constitution. Two completely different claims. And a Supreme Court trying to decide who is right. ⚖️

In today’s Supreme Court hearing on the Shiv Sena split, Kapil Sibal’s strongest argument revolved around one document — the 2018 Shiv Sena Constitution.

His argument: How can the Shinde faction rely on appointments made under the 2018 Constitution, while now claiming that the same Constitution was never validly before the Election Commission?

But the Shinde faction hit back with a crucial point:

The Election Commission itself recorded that the 2018 Constitution was neither on its records nor registered with it.

And that was only the beginning.

The hearing went deep into some of the biggest questions arising from the Shiv Sena dispute:

🔹 Can the Election Commission examine a party’s internal constitution?
🔹 Does legislative majority determine who controls a political party?
🔹 Or should the organisational structure and party members matter more?
🔹 Can a party’s internal democracy become the basis for deciding its symbol?
🔹 And if a Constitution was relied upon for appointments, how can its existence later be disputed?
Justice Joymalya Bagchi had earlier questioned whether the Election Commission had asked the “wrong question” by focusing on the legislature instead of the political party.
The Shinde faction’s response? The number of MLAs and votes cannot simply be ignored.
And beneath all these arguments lies one much bigger question:
Who is the “real” political party — the organisation, its elected representatives, or the people who control its structure?

The Supreme Court will continue hearing the matter on September 15.
