ศาลฎีกามีคำพิพากษา���นึ่งคดี ที่เปลี่ยนวิธีคิดของระบบบัตรเครดิตทั้งประเทศ

คดีนี้มีคำถามง่ายๆ แค่ข้อเดียว คือ

ถ้าบัตรเครดิตถูกคนร้ายเอาไปใช้
ใครควรเป็นฝ่ายพิสูจน์ว่า “ใครเป็นคนรูด”?

เรื่องนี้เกิดขึ้นจาก ผู้บริโภครายหนึ่ง ถูกมิจฉาชีพนำข้อมูลบัตรเครดิตไปใช้รูดซื้อสินค้า

ซึ่งเจ้าของบัตรยืนยันว่า

- ไม่ได้เป็นคนใช้
- ไม่เคยอนุญาต
- ไม่รู้เรื่องมาก่อน

แต่ธนาคารกลับเรียกเก็บเงิน
โดยอ้างว่า “ตามสัญญา ผู้ถือบัตรต้องรับผิด”

ผู้บริโภคไม่ยอม คดีเลยขึ้นไปถึงศาลฎีกา

ศาลฎีกาตอบชัดมากว่า แค่มีรายการใช้บัตร

ไม่ได้แปลว่าเจ้าของบัตรเป็นคนใช้เสมอไป และประเด็นสำคัญคือ

คนที่ต้องพิสูจน์ ไม่ใช่ผู้บริโภค
แต่คือธนาคารผู้ออกบัตร เพราะศาลมองว่า

- ธนาคารเป็นคนสร้างระบบบัตรเครดิต
- เป็นคนออกแบบระบบยืนยันตัวตน และเป็นฝ่ายได้ประโยชน์จากค่าธรรมเนียมและดอกเบี้ย

ดังนั้น
ถ้าเกิดปัญหาจากระบบ

ภาระต้องกลับไปที่คนสร้างระบบ

ไม่ใช่โยนให้ลูกค้า��ิสูจน์ความบริสุทธิ์ของตัวเอง

ศาลวางเส้นไว้ชัดเจน ถ้าธนาคารพิสูจน์ไม่ได้ว่า

- ผู้ถือบัตรเป็นคนรูดเอง
หรือ
- ผู้ถือบัตรประมาทร้ายแรงจริง

ศาลจะไม่บังคับให้ผู้บริโภคจ่ายเงินแทนมิจฉาชีพ

คำตัดสินสุดท้าย ศาลฎีกา
ยกฟ้องผู้ถือบัตรเครดิต

ทำให้ผู้บริโภค ไม่ต้องรับผิดยอดใช้จ่ายที่ถูกโกง

เพราะธนาคาร พิสูจน์ไม่ได้ว่าเขาเป็นผู้ใช้บัตรจริง

เรื่องนี้สำคัญยังไงกับทุกคน

คำพิพากษานี้ไม่ได้ช่วยแค่คนเดียว
แต่เป็นการ “ตั้งระเบียบใหม่” ให้ระบบการเงิน

จากเดิม

ลูกค้าต้องกลัวว่าโดนโกงแล้วจะต้องจ่ายเอง กำลังเปลี่ยนเป็น

ธนาคารต้องรับผิดชอบต่อความปลอดภัยของระบบมากขึ้น

หลังจากนี้ ธนาคารเลี่ยงไม่ได้

- ระบบยืนยันตัวตนต้องแน่นขึ้น
- ระบบตรวจจับการโกงต้องจริงจังขึ้น
- ไม่สามารถใช้สัญญามาตรฐานมาปิดเกมลูกค้าได้ง่ายๆ

เพราะถ้าพิสูจน์ไม่ได้ว่า “ใครเป็นคนรูดจริง”

ศาลก็จะไม่ยอมให้ลูกค้าเป็นฝ่ายจ่าย

ตอนนี้��ึงบัตรเครดิตถูกโกง ก็ไม่ใช่หน้าที่ลูกค้าที่ต้องพิสูจน์ว่า “ตัวเองไม่ได้โกง”

แต่เป็นหน้าที่ธนาคารที่ต้องพิสูจน์ว่า “ลูกค้าเป็นคนใช้จริง”

ถือเป็นข่าวดี ของผู้ใช้บัตรเครดิตทุกคน เห็นของคริปโตบางเจ้าก็มีเพื่อนถูกเอาไปรูดเหมือนกัน ยังไงก็ระวัง ๆ ตัวกันด้วยน้า

Why we did this?
