🇪🇸 Applying for a Digital Nomad Visa Through the Spanish Consulate in Chicago: RETA and Social Security Requirements
📋 In a case currently being handled by Tejada Solicitors, Requirement No. 13 of the Consulate’s document checklist expressly states that the following documents are accepted:
✅ Proof of registration with the Spanish Social Security system.
✅ Proof that the applicant has applied to register under RETA, Spain’s Special Social Security Scheme for Self-Employed Workers.
⚠️ Here is the difficulty: generally, a self-employed applicant cannot complete an effective RETA registration before obtaining the visa or residence authorisation that legally permits them to work in Spain.
Consequently, a RETA registration application submitted prematurely could be rejected or have no legal effect.
🔎 This differs from the procedure followed by Spain’s Large Companies and Strategic Groups Unit (UGE).
For applications filed from within Spain, the UGE’s official guidance requires self-employed digital nomads to provide:
📝 A formal commitment to register under RETA once their residence authorisation has been granted; and
⏳ Confirmation that registration will be completed before beginning their professional activity in Spain.
Under this procedure, applicants are not normally required to provide proof of prior RETA registration.

Applicants should approach Requirement No. 13 with particular caution and obtain appropriate advice before submitting their application.

Spain Proposes New Flood-Risk Disclosure Rules for Property Sales
A draft Royal Decree has recently been published that is designed to strengthen flood-risk management and transparency in property transactions. From 16 July to 16 September 2026, it was subject to public consultation and is yet to be enforced.
If it is approved, it would be mandatory for property owners in Spain to state in the deed of sale if their property is located in a preferential flow area or another officially recognised flood-risk zone, according to Spain’s National Flood Zone Mapping System.
In addition, this information would be recorded at the Land Registry. Without the required declaration and the corresponding registry note , the transfer may not be successfully registered.
Flood risk should already be part of legal and technical due diligence as it can affect personal safety, planning restrictions, insurance availability and premiums, potential for future development, and resale value.
