@NehaAisa The key legal issue is not simply that Neha Bora was kept overnight. It is whether Delhi Police had lawful grounds to restrain her liberty, what provision they were acting under, and what legal authority justified continuing to hold her.

Was this detention lawful? Police cannot evade safeguards by merely calling custody “detention.” If it is arrest, BNSS Sec.43(5) restricts the night-time arrest of women.
Peaceful protest is not a crime. The law binds the police too.

We strongly condemn the detention of AISA President Neha Bora by Delhi Police at Mandi House on 16 Oct while on her way to a peaceful protest. Her location was initially undisclosed,& AISA alleged denial of lawyers access.
