62 questions the Texas Legislature should ask Spring Branch ISD

I. The SB 571 referral requirement (Chief Baimbridge, Dr. Blaine)
1. Chief, since SB 571 took effect on June 20, 2025, how many allegations against district employees has Spring Branch ISD referred to an outside law enforcement agency as the statute requires? Please break that down by receiving agency: Houston Police Department, Harris County Sheriff's Office, the Memorial Villages police departments, and DPS.

2. Of those referrals, how many resulted in the outside agency declining to investigate, how many in an open case, and how many in charges filed?

3. Before SB 571, in the 2023-24 and 2024-25 school years, how many allegations against district employees did the SBISD Police Department investigate itself, and how many of those investigations resulted in a referral to the district attorney? How many resulted in charges?

4. In the December 2023 case of a Memorial High School teacher charged with an improper relationship with a student, SBISD police conducted the investigation. Did the department at any point notify HPD or the sheriff's office? On what date did the district notify TEA?

5. Does the SBISD Police Department report to the superintendent? Does the chief serve at the pleasure of the superintendent and the board? If the superintendent or a trustee is the subject of an allegation, who investigates?

6. Has the district ever had a case in which an SBISD police investigation of an employee was closed as unfounded and an outside agency later filed charges on the same conduct? If you do not know, will you commit to checking and reporting back to this committee within 30 days?

7. Dr. Blaine, your staff testified to the board on September 14 that employees sometimes wait hours for HPD or CPS to respond. Has the district documented those response times? Will you provide the committee the log of referral dates, agency, and response times since June 2025?

8. Has the district sought a memorandum of understanding with HPD, the sheriff's office, or the Villages police departments to expedite response to campus referrals? If not, why not?

II. Caseload (Chief Baimbridge, HR officer, Dr. Blaine)
9. Chief, how many sworn officers does the SBISD Police Department have today? How many are assigned to campuses, how many to patrol, and how many to investigations? How many hold a TCOLE investigator or detective classification?

10. How many of your officers have completed the Child Abuse Investigation or Crimes Against Children training that HPD and the sheriff's office require of their investigators in those units? How many have completed forensic-interview training? Does the department use the Children's Assessment Center for forensic interviews, and how many were referred there in each of the last three years?

11. How many criminal cases did the department open in each of the last three school years? Please break them down by category: offenses by students, offenses by employees, offenses by outsiders on campus, and traffic.

12. Of the cases in which an employee was the suspect, how many did each investigator carry at once? What was the department's average time from report to case closure for employee-suspect cases in 2023-24 and 2024-25?

13. How many employee-suspect cases did the department close as unfounded or inactive in each of those years? How many were referred to the district attorney? How many were accepted for prosecution?

14. In how many employee-suspect cases did the investigating officer work on the same campus as the suspect? What is the department's policy on that?

15. HR: how many misconduct investigations has the district's HR department opened in each of the last four school years? How many staff members conduct them? What is the current number of open investigations, and how many have been open more than 60 days?

16. How many employees are on administrative leave today pending a misconduct investigation? What was the total cost of substitute coverage for employees on leave pending investigation in 2025-26?

17. Dr. Blaine, your staff told the board on September 14 that administrators sometimes wait until 9, 10 or 11 at night for HPD or CPS to arrive. How many such incidents has the district logged since June 2025? In how many of those did the district's own officer remain on campus during the wait?

18. In those cases, once the outside agency arrived, how many resulted in the agency taking a report, how many in the agency declining, and how many in charges?

19. Has the district asked HPD or the sheriff's office how many educator-misconduct referrals they received from all districts in Harris County in 2025-26, and what their average response time is? If the district's position is that those agencies are overwhelmed, what data is that based on?

20. The district says it has an officer on every campus at a cost the state does not fully fund. Since SB 571 removed employee-misconduct investigations from the department's caseload, what is the department's officers' current caseload per investigator? Has the department reassigned any investigative staff?

21. If the Legislature restored a district police department's authority to investigate its own employees, how many additional investigators would Spring Branch need to handle that caseload at the same clearance rate as HPD's Crimes Against Children unit, and at what cost?

III. The trustee's account of Rep. Little (Trustee Earnest)
22. Mr. Earnest, on September 14 you told the board that "the police officer thing" was "a bill by Mitch Little." Senate Bill 571 was authored by Senator Bettencourt and carried in the House by Representatives Leach, Buckley, Noble and Frank. Which bill were you referring to?

23. You told the board, "I've talked to Mitch about it. Mitch doesn't trust local PDs, including our own." When and where did that conversation take place? Was anyone else present?

24. You said Representative Little "has that opinion of Chief Baimbridge." Did Representative Little name Chief Baimbridge in your conversation, or is that your characterization?

25. Do you accept that Representative Little's bill, HB 4623, concerns civil liability for districts that are grossly negligent in hiring or supervising an employee who abuses a student, and not which agency investigates allegations?

26. Does Spring Branch ISD oppose HB 4623? Has the district or the board taken a position on it?

IV. The misconduct reports (Trustee Earnest, HR officer)
27. Mr. Earnest, you told the board the misconduct-report emails you receive are "probably three or four times" the number of a few years ago, and that you "don't think that we have three or four more times the legitimate cases." How many misconduct reports has the district submitted to TEA or SBEC in each of the last four school years? Please provide the number, not an estimate.

28. Of the reports submitted since SB 571 took effect, how many resulted in a substantiated finding by the district's own HR investigation? How many resulted in resignation before the investigation concluded? How many resulted in termination?

29. How many of those reports involved an allegation of an inappropriate relationship or inappropriate communication with a student?

30. You said the reporting requirement is "intentional" so that "someone's gonna write an article" that reports have skyrocketed. Is it the district's position that the Legislature enacted the 48-hour reporting requirement to damage public schools' reputation? Is that the position of the board?

31. In the 2025-26 school year, did the district miss the 48-hour reporting deadline in any case? How many times? Were any of those instances reported to TEA as late?

32. Before SB 571, when the district had ten days to investigate before reporting, how many allegations were resolved internally without ever being reported to SBEC?

V. The Patrick allegation (Trustee Earnest, President Anderson)
33. Mr. Earnest, you told the board that "Dan Patrick has grandchildren in our district," and that when you were "creating a fuss with Bettencourt and others" two years ago, someone "messaged through family in our district that there was no way in hell that Spring Branch was getting more money and y'all need to pipe down." Who delivered that message? To whom? On what date?

34. Did you receive that message in writing? Will you produce it to this committee?

35. Did you report that communication to the board, to the superintendent, to the district's general counsel, or to any law enforcement agency at the time? If a trustee believed a state official had used a family in the district to pressure the board, why was it never raised until a workshop two years later?

36. Ms. Anderson, as board president, were you aware of that allegation before September 14? Has the board taken any step to substantiate it since?

VI. "Immigrant or whatever" (Trustee Tredennick)
37. Mr. Tredennick, you told the board that Spring Branch "is not the same as the district community that's largely uneducated, not educated, but let's say immigrant or whatever," and that this is your "response to Mano" and "to Lacey." Which districts were you describing?

38. Roughly what share of Spring Branch ISD students are economically disadvantaged, and what share are emergent bilingual? Do those students attend the same district you were asking the Legislature to exempt from statewide rules?

39. Is it the district's position that the Legislature should apply different educator-misconduct or reporting rules to districts based on the education level or immigration status of their communities? If not, what carve out were you asking Representatives DeAyala and Hull for?

40. Representatives DeAyala and Hull endorsed your campaign in May. Have you conveyed that "response" to them directly? What was their answer?

VII. Local control and the board's ask (President Anderson, Dr. Blaine)
41. Ms. Anderson, you told the board on September 14 that the rules enacted by the Legislature and TEA "feel like a clown show," that they are "set by legislators who've probably never been in a classroom," and that "they're hurting children." Which specific statutes were you describing? Which of them is the district asking this committee to repeal?

42. You also said the district is "begging for local control from conservative leaders." What specific statutory exemption is the district asking for? Is it an exemption from the SB 571 referral requirement, from the 48-hour reporting requirement, or from both?

43. If the Legislature created a carve out allowing a district police department to investigate its own employees, what objective criteria would you propose for which districts qualify? Who would certify that a district meets them, and who would revoke it?

44. Dr. Blaine, the district told the board it is making $28 million in cuts and has reached the limit of its fund balance. What is the district's current unassigned fund balance as a percentage of expenditures? What was it in 2019?

45. Since 2019, what has been the change in the district's total enrollment, total staff headcount, and central administration headcount?

46. The district said HB 2 pays $1,000 per special education evaluation against a cost of about $3,000. How many evaluations did the district conduct last year for students who were not enrolled in the district? Does the district track that number?

47. The board discussed a Budget Advisory Committee of 25 to 30 community members. Will the district provide this committee the membership list and the materials presented to it?

VIII. Use of the grand jury process (Chief Baimbridge, Dr. Blaine, district general counsel)
48. Chief, since January 1, 2023, how many grand jury subpoenas has the Spring Branch ISD Police Department requested from the Harris County District Attorney's Office, or from any other prosecuting authority? Please provide the number by calendar year.

49. For each of those subpoenas, what category of records was sought: telephone or text records, email, social media account records, bank or financial records, school records, or other? To whom was each directed?

50. How many of those subpoenas were issued in a matter that was subsequently presented to a grand jury? How many were issued in a matter that was never presented to a grand jury? How many were issued in a matter that was later closed without charges?

51. Has the department ever requested a grand jury subpoena for the records of a district employee, a parent, a trustee, a candidate for the board, a journalist, or a member of the public who had criticized the district, filed a grievance, filed a Public Information Act request, or spoken at a board meeting? If you cannot answer today, will you commit to a written answer within 30 days?

52. Has the department ever requested a grand jury subpoena for records of a student or a student's family in a matter that did not involve an allegation of a crime against that student?

53. What is the department's written policy on when an officer may request a grand jury subpoena, who must approve the request inside the department, and whether the superintendent or general counsel is notified? Will you provide that policy to the committee? If there is no written policy, why not?

54. Who inside the district has access to records obtained by grand jury subpoena? Are they stored in the police department's records system, the district's HR system, or both? Has any record obtained by grand jury subpoena ever been shared with the superintendent, a trustee, the HR department, or outside counsel in a civil or employment matter?

55. Has the district ever used information obtained by grand jury subpoena in an employment action, a grievance response, a Level III hearing, a nonrenewal, or a civil lawsuit? How many times?

56. Has any assistant district attorney, judge, or grand jury foreperson ever declined, quashed, or questioned a subpoena requested by the department? How many times, and in what years?

57. Has the department ever referred a matter to a grand jury that a grand jury no-billed? How many since January 1, 2023? For each, was the subject a district employee, a parent, a student, or a member of the public?

58. Dr. Blaine, were you informed of each grand jury subpoena request made by the department? Was the board? If not, do you believe the board should be?

59. Does the district's police department have a written agreement or standing arrangement with the Harris County District Attorney's Office governing how subpoenas are requested and returned? Will you produce it?

60. Article 20A of the Code of Criminal Procedure governs grand jury proceedings and secrecy. Has the district ever obtained a legal opinion, from general counsel or outside counsel, on the department's use of grand jury process? Will you provide it, or if privileged, its date and author?

61. Would the district object to an independent audit of the department's use of subpoena and grand jury process since 2023, conducted by the Texas Commission on Law Enforcement or the State Auditor's Office, with the results reported to this committee?

IX. Closing
62. Is there anything said at the September 14 workshop that you would like to correct or withdraw for the record today?
