Political drums have started in earnest. Those in government projects are feeling the heat. Two (2) questions you must have correct answers:

1. Can the employer exercise the Engineers powers?
2. Can you pick instructions from H.E the President?

If you are the Resident Engineer for a GoK project you will hear Presidential declarations to terminate projects, “huyo Contractor afukuzwe kazi mara moja!” Remember President Ruto got a very sharp memory.

Next is calls to assist the contractor expedite progress. Requests from the Client or Employer for front loading the Payment Certificate, to overlook Liquidated Damages, favorite recommendations on Certain claims, Pay for Materials on Site, allow the Contractor to progress with works without paying salaries/wages to project staff, or to go slow on certain Contractual Provisions.

Remember, as our people have fondly said, ‘a woman who carries her head on a rigid neck will never live for long with any husband’! You either shape in or ship out.
