The Court of Appeal of Kenya held that under section 79(3) of Kenya's Land Act, 2012, spousal consent to charging a matrimonial home is required from a spouse residing on the property, not every spouse of the chargor. Accordingly, although the appellant established that she was the chargor's wife under Meru customary law, her consent was unnecessary because she had never lived on the charged property. The Court upheld the charge and dismissed the appeal.

In Kageni v Bank of Africa (K) Ltd & 3 Others, Civil Appeal No. 186 of 2018, [2026] KECA 1921 (KLR) (25 September 2026), the Court of Appeal of Kenya dismissed an appeal challenging the intended auction of property charged to secure a KShs 20.6 million loan advanced by Bank of Africa to United Brothers Camps Ltd. The appellant, Elyjoy Kageni, argued that the charge was invalid because she was the chargor's first wife under Meru customary law and had not consented to the transaction.

Although the Court disagreed with the trial court's finding that she had failed to establish her marriage, it held that section 79(3) of the Land Act, 2012, requires consent from a spouse residing in the matrimonial home. Since the appellant had never lived on the charged property, while another wife, Lucyline Kanyua Mutindwa, resided there and had expressly consented to the charge, her consent was not required.

The Court also found that the bank was unaware of the appellant's existence, which the chargor had not disclosed, and had complied with the statutory notice requirements under sections 90 and 96 of the Act. It consequently upheld the refusal to restrain the sale and dismissed the appeal with costs to the bank.

I watched a video done by a cancer researcher on why one shouldn’t spray their perfumes on the neck and it was worth it. The neck is one of the highest blood flow on the body. Its skin is very thin which means fragrances and chemicals get absorbed faster and deeper. She explains most of the perfumes and cosmetic products have endocrine disruptors which mimic or block our hormones. Most studies link them to infertility, respiratory problems and cancer.
