The Shiloh Hendrix case isn't even a close call or a grey area. She was charged and convicted of a crime for saying a word. If that's not a violation of the First Amendment, nothing is. This is one of the most straight forward free speech issues we've seen in a long time.

@Bibichut Why can't it be both? It breaks the consistency and thematic logic of the story, which both hurt said story. Doctor Who has gotten far too comfortable disregarding it's own events, and not just what was established 50 years ago, but also what was established a year or two prior.
@Greenpartygirly There was a comic from Doctor Who Magazine where Twelve and Clara run into another Clara echo, and while Clara expects her to die by the end, the echo survives and Clara realizes to her excitement that she doesn't always die in these other lives.
@abitdickensian Still makes no sense if you actually watched classic who. The Doctor having incarnations before Hartnell, sure, it's possible. But an incarnation who is referred to as the Doctor and has a TARDIS shaped like a police box when both of those originate with Hartnell. Not a chance.
