The Supreme Court, also known as Brahmin-Bania arbitration centre, is diluting the SC/ST act.

I will shorten by counter arguments to ten short points
[1] Creamy layer among SC/ST - Should not be implemented as per 9 bench judgement of Indra Sawney supreme court order. So only 11 bench can over rule this
[2] Creamy layer is identification of socially advanced person. It is not a economic criteria. Among dalits, even if he becomes rich or occupies higher position, the stigma of untouchability does not go. His position in social hierarchy does not change.
[3] To say that only IAS's officers kids are getting all the jobs is a complete myth. Recent studies shows that this percentage is very low and has no basis.
[4] In the recent Rohit Nathan Supreme Court case, this principle was again upheld that creamy layer is identification of socially advanced person. It was for this reason salary was excluded from original computation for OBCs
[5] In the original report given after Mandal commission, creamy layer was not to be implemented even for EBCs. So the real issue now is how to remove creamy layer from Extremely Backward classes.
[6] Data suggests that even 15% SC reservations are not met anywhere. If out of 100 seats, if 15 seats have to be filled but only 7 are filled up and 8 are left vacant. Introducing creamy layer will make this more skewed with only 3 or 4 seats getting filled up. NCBC has strictly mentioned that first step should be to fill up the seats by respective backward classes and not to allow it to go vacant.
[7] Now to introduce creamy layer or not is the privilege of the parliament. Two thirds majority is needed to pass this law. After the failure of women's reservation bill it is almost impossible to implement this through a legislation.
[8] Bihar caste census showed that 0.5% of the SC/ST population had income more than Rs 66000/- per month. So creamy layer itself is tiny. So no point to introduce creamy layer with scheduled castes
[9] Statistics shows that most of Dalits and Adivasis are represented only in Group C and D jobs, while there representation in Group A especially and places like Joint secretaries is dismal. Introducing creamy layer will affect promotional avenues and leads to a skewed allocation at the top.
[10] Lastly, creamy layer is a equality concept. If introduced it should be introduced even in General category. If two generations of lawyers have practiced in supreme court from a particular family, should a third generation allowed to practice
What's missing after 2014 is pre 2014 media and civil society that questioned govt on it's failures and kept govt on it's toes irrespective of which party is ruling in Centre! We finally seeing the awakening of civil society in form of Cockroach party of India.
We finally seeing youth and students grilling the govt and putting them in corner through this party. For god sake let them do that.
