Hi @jamesmurray_ldn You said in 2022 that you believe trans women are women. This morning on BBC Radio 4 you said you would not say that anymore. 

You are the new Health Secretary. You are gay. You know what it is to have your existence questioned by people in power. And today you chose to do that to someone else.

So let us talk about the science you just decided to ignore.

The brain and the body do not develop at the same time in the womb. The genitals differentiate first. The brain follows weeks later on a completely separate hormonal timeline. When those timelines differ the result is a person whose neurological identity does not match the body they were born into. This is documented embryology. It is in peer reviewed journals. It was understood before the Supreme Court existed.

The bed nucleus of the stria terminalis differs between trans and non-trans people regardless of whether they have received any medical treatment. This is brain structure. It is present before any intervention. It is developmental. It is biological.

Twin studies show concordance rates for trans identity that cannot be explained by social influence. Genetics show variants in hormone receptor pathways at higher frequencies in trans populations. Prenatal hormone exposure has been directly linked to identity outcomes in documented clinical research.

The World Health Organisation says being trans is not a mental disorder. The American Medical Association agrees. The British Psychological Society agrees. The Royal College of Psychiatrists agrees. The Endocrine Society agrees.

You told the BBC this morning that the Supreme Court has ruled very clearly that biological sex is what matters. 

The Supreme Court ruled on a legal definition in one specific piece of legislation. It did not conduct a biology review. It did not commission neuroscience research. It did not examine prenatal hormone studies or twin data or brain imaging. It made a legal determination about the Equality Act.

Legal definitions and biological reality are not the same thing. A court ruling does not change what happens in a womb. A court ruling does not alter brain structure. A court ruling does not make decades of peer reviewed research disappear.

You used to know that trans women are women. The science has not changed since 2022. You have.

That is not clarity. That is capitulation.

And it comes on the same day you became the Health Secretary responsible for the healthcare of every trans person in this country.

They deserved better than this on your first day.

While it appears that the government has successfully pushed back on some particularly harmful elements in the previous draft, the new Code of Practice will still lead to the exclusion of trans people from services and facilities that they have used without issue for a very long time.

This will do nothing to improve women’s lives and the many struggles we face, but it will put trans people (and anyone perceived as trans) at increased risk of discrimination, harassment and violence. The Code unfortunately still represents the culmination of years of anti-trans campaigning from a small, well-funded minority who have had outsized influence in the media and in politics, and have weaponised the courts for their own ends.

The legal situation for trans people is now deeply incoherent and means that it is untenable for them to be able live their lives with dignity. This is completely out of line with the values of equality that a Labour government is meant to champion. Instead of making this Code statutory, the government should be legislating to clarify and protect trans people’s rights, privacy and inclusion.
