🚨 Hadley v. Perez Update
After Demoree Hadley’s attorney filed supplemental declarations from B.J. Courville (BJ Investigates) and Zachary Williams (Demoree Docket), Desiree Perez’s legal team moved to strike those filings. They argued the supplemental declarations were untimely, that leave of court was never requested, and asked the Court not to consider them when ruling on the pending sanctions motion.
Overnight, however, the Court struck Perez’s motion to strike before even reaching the merits.
In a paperless order, Magistrate Judge Lauren Louis ruled that the motion violated Federal Rule of Civil Procedure 11(a) because neither the motion nor the certificate of service was signed.
The Court went a step further, directing Perez’s side not to file an amended version of the motion and stating that it was unnecessary to file a motion asking the Court to apply the Local Rules of the Southern District of Florida.
As it stands, the motion seeking to exclude the Courville and Williams declarations has been removed from the docket, meaning those supplemental filings remain part of the record unless the Court orders otherwise at a later stage.
