The Oath of Office Is Sleight of Hand

Right There in the Title — "Oath of Office" — Their Oath Is to the Office, Not to You

Long version. Short version in the next post.

Before we begin, let me be clear:

This post is about what the "oath of office" actually says — and who it is actually for. It is not about whether public servants are good or bad. It is about the plain text of the oath they swear and to whom they swear it.

1. Who Must Take the Oath?

Nearly everyone in government power must swear one:

- President and Vice President

- Members of Congress

- Federal and state judges

- Governors, legislators, and local officials

- Most civil servants and uniformed service members

Article VI of the U.S. Constitution requires it. The pattern is the same everywhere: loyalty to the Constitution and the office.

The ceremony is designed to look like accountability. The text tells us a different story.

This post focuses on the federal judicial oath.

2. The Federal Judicial Oath (28 U.S.C. § 453)

Let us walk through it line by line.

"I, [name], do solemnly swear (or affirm)"

This is the formal beginning. "Swear" invokes God; "affirm" is for those who do not want to invoke God. It is a public, binding declaration.

This sounds like a promise to you. It is not.

"that I will support and defend the Constitution of the United States against all enemies, foreign and domestic"

The judge swears to protect the Constitution from threats — both external (foreign nations) and internal (including bad laws, corrupt officials, or even misguided citizens). This is a duty to the Constitution as written and interpreted, not to any individual person.

The living men and women are not mentioned. We never are.

"that I will bear true faith and allegiance to the same"

This is loyalty to the Constitution itself. The judge is pledging allegiance to the document and the system it created — not to any private individual, "living man," or natural rights.

Not to you. Not to your rights. To the document and office it created.

"that I take this obligation freely, without any mental reservation or purpose of evasion"

This is very important.

The judge is saying: "I mean this. I'm not crossing my fingers. I'm not secretly planning to subvert it." This line directly undercuts claims of "mental reservation," fraud, or hidden allegiance.

The judge is not tricking you. The oath means what it says.

"and that I will well and faithfully discharge the duties of the office on which I am about to enter"

The judge promises to do the job honestly and competently. "Duties of the office" are defined by statute, court rules, and the Constitution — not by any individual litigant's interpretation.

We do not define their duties. The system does.

"So help me God." (optional in some versions)

A traditional invocation asking for divine help. Many judges still use it, but it is not required.

This does not mean the judge answers to God over the Constitution. It is ceremonial.

3. What the Oath Does NOT Say

Nowhere in this oath does the judge promise:

- To protect living individuals

- To defend your individual rights

- To uphold natural law or God's law

- To answer to us for their decisions

The oath is a closed loop.

The system swears loyalty to itself.

4. The Constitution, "the People," the Hidden Structure

Here is the part most never see — and once you see it, the whole picture becomes clear.

The Constitution is a blueprint.

It is a design document for creating and operating a government. It creates offices, defines powers, and sets limits.

It is not a love letter to living individuals.
It is the source code of the system.

"We the People" is not the living.

The Constitution begins with the words "We the People."

Most assume this means the living men and women walking the land today.

It does not.

"The People" is a collective political identity — a political persona — created for the purpose of establishing a government.

It is not a biological category.
It is not a spiritual category.
It is not the living man or woman.

It is the sovereign political body that created the federal government.

And here is the truth that matters:

- It does not govern the living man or woman — it governs the government.

The oath binds officials to that blueprint — not to you.

It limits government action toward living individuals, it does not create a personal contract with any living individual.

You did not sign it.
You cannot withdraw from it.
You cannot enforce it as a personal contract.

It is not a covenant with living individuals.

Your rights existed long before the Constitution. They exist after it. They come from the Creator, not from parchment.

The Ninth and Tenth Amendments confirm this. They state that the enumeration of certain rights shall not deny others retained by the people, and that powers not delegated are reserved to the states or the people.

The Bill of Rights does not grant rights — it acknowledges them and limits the government.

But even with all of that, the core truth remains:

- The Constitution limits the system, not the living individual.

- The oath binds officials to the Constitution, not to you personally.

This is the sleight of hand hidden in plain sight.

But the sleight of hand does not end there.

5. Public vs. Private — A Useful Perspective

Legal scholars have long recognized a distinction between the public realm (government, offices, institutions, and collective political power) and the private realm (the individual, family, conscience, and personal autonomy).

In this view:

The Constitution primarily governs the public realm. It creates offices, defines powers, and sets limits on government action.

It does not directly command or control individuals in their private capacity. Instead, it restricts what government can do to individuals.

This is why the oath of office binds officials to the public realm — to the Constitution, the statutes, the office, and the political structure.

The judge swears loyalty to the system and the duties of the office, not to any private individual.

This perspective helps explain why the oath often feels impersonal. It was written for the institution, not as a personal promise to you.

The oath does not say "I will protect living individuals." It says "I will support and defend the Constitution."

That is because the oath was written for the public realm — not as a personal promise to you.

6. The Sleight of Hand

The ceremony is designed to look like accountability to living individuals. The raised hand. The solemn words. The Bible.

But the text tells the truth:

- The judge swears loyalty to the Constitution and the office — not to you.

- The judge swears to discharge the duties of the office — the duties defined by the system, not by living men and women.

You have been sold a story: that the oath is a shield for the innocent and a sword against the oppressor.

The oath is neither.

It is a leash — binding the judge to the system, not to you.

7. The Treason Myth

Many people believe that because they cannot use the Constitution in court, the judge is committing treason. Or that a judge who refuses to produce their oath has no authority.

This is a misunderstanding.

The judge owes their allegiance to the system and the office they are sitting in — not to you. Their oath is not a promise to any individual person — it is a promise to the office.

Even if the judge did produce their oath, they are still not committing treason. The judge is being exactly as loyal as they swore to be — to the Constitution, to the laws, to the office.

8. The Irony of Demanding the Oath

There is an irony here that most people miss.

When someone demands to see the judge's oath, what are they really asking for?

- They are asking the judge to confirm that they swore loyalty to the Constitution and the office it created.

- They are asking the judge to prove they are bound to the system.

Is that really what you want to ask a judge for?

Proof that they are loyal to the Constitution and the office they swore to uphold?

The judge's oath is not a secret. It is a matter of public record. The judge took it. They mean it.

They are being exactly as loyal as they swore to be.

When you demand the oath, you are not exposing a fraud. You are asking the system's agent to reaffirm their loyalty to the system.

That does not void jurisdiction. It confirms it.

The judge is doing exactly what they swore to do. You are asking them to prove it.

And they can.

This is the sleight of hand within the sleight of hand.

The very act of demanding the oath — the act you thought was a weapon — is itself participation in the system's ritual.

Bottom Line

The oath of office is not a promise to the people. It is a promise to the system.

The title says "Oath of Office." Not "Oath to Living Individuals."

That is prima facie evidence. The meaning is on its face. No interpretation is needed.

The light has been shining in plain sight the whole time. Only those with eyes to see will see.

Stop believing the ceremony. Read the words. See who they are actually for.

Know Thyself. Free Thyself.

My question is why they take an oath at all. Without the general customary ceremony, we would start asking too many questions I guess. All oaths in USA, save a very few, are not actually conducted properly, in the exact manner the constitution outlined. So they are all fully null and void, as if they never actually happened at all.
