Hayi maarn, kanti what role does amicus curiae exist for if the court can not consider positions beyond statutes?
It does consult beyond statutes through invites (representations). In has done in many cases; Makwenyane, TAC etc.
Check facts before condescending people.
The problem here is everyone is quick to answer the conceptual view of the case but not the practical aspects. Things like, after the application is made, where does the applicant go? how long does it take for them to be responded to? Whilst waiting are they stateless?
I always say that people react differently to issues depending on how directly those issues affect them. I’ve watched several people here on X, whose names I won’t mention, insult and ridicule South Africans who have taken to the streets to express their frustrations. It’s easy to dismiss people’s concerns when you’re not the one living with the consequences. You don’t have to agree with the marches but the arrogance of treating everyone who participates as ignorant or uninformed is astounding. Your personal circumstances don’t invalidate someone else’s lived reality.
He's probably in Malawi, back to his house.. Will lay low for 2 years and come back again illegally, our home affairs will reward him with documentation to be legal and he will get employment, tenders and 1 day get drunk and threaten women at a restaurant. The South African story
I really do not understand how you'd not support what this guy is saying as a south african. He is literally advocating for you to be prioritized IN YOUR COUNTRY!!!!
Foreign owned Tshwane spaza shops moved R6.3 billion to fund terrorism, a recent report has found.
South Africa is not going to be fixed using conventional methods such as elections, parliament, courts.
Phakela Krugersdorp Concourt Jacinta Home Affairs
South Africans of all races, wake up. We are not safe from ANC led government and their foreign military men flooding the country masquerading as asylum seekers. Let us all together defend South Africa from ANC treachery and invading hostile armies before it’s too late.
If you want fully understand the Scalabrini judgement (cause of mayhem), read not only the judgement itself but the pleadings (Applicant's founding affidavit, suppl, Respondent's answer & amicus curiae submissions).
Its confusion everywhere.

All of our MK veterans will tell you the same thing, South Africans were placed in camps and weren’t treated with kid gloves, they couldn’t roam around demanding asylum.
A murderer who left Japan for SA, overstayed his visa. Home Affairs couldn’t pick this up for 17 years.
Home Affairs cannot even locate where the “asylum seekers” are in the country. They get their permits and get released into the communities, and Home Affairs relies on the goodwill of the applicants should there be any issue on their status.
What you and others seem to fail to grasp is that rejection isn’t the only issue. Asylum applications and appeals can take years to finalise. What happens to applicants during that period? Where are they accommodated? How do they support themselves? What additional pressure does this place on already overstretched public services? And what happens when their applications are eventually rejected? Have you considered any of these practical implications or does your understanding of the issue begin and end with “they can still be rejected”?
Asylum seekers waiting in snaking queues in Marabastad say the locals' protest has disturbed the processes that started smoothly earlier today. @LindA_MniSii reports.
