This morning, the West Bengal Police landed unannounced at the Noida residence of journalist Surajit Dasgupta. The purpose was clear: to arrest him for allegedly sharing chats between a Trinamool Congress MP and her paramour. The contention, conveniently advanced, is that the chats were “fake.” That they could not arrest him is another matter altogether. But a fundamental question arises - who decides whether these chats are fake or genuine? Certainly not the Krishnanagar police.

Moreover, if private chats between two individuals find their way into the public domain, logic dictates that the source of the leak can only be one of the two parties involved, the sender or the receiver. So why is the state police machinery being weaponised against those who merely amplify what is already circulating in the public domain? Why target individuals who are, in effect, only sharing what others are discussing? The Superintendent of Police, Krishnanagar, must remember that his duty is to serve the people of West Bengal, not to pander to the petulance and sensitivities of an errant MP.

Coming to the substance of the situation at hand.

The Constitution of India is unambiguous: every citizen is presumed innocent until proven guilty. Yet, in this case, the West Bengal Police appear to have discarded constitutional safeguards and due process with alarming ease.

For offences carrying a sentence of up to seven years, the law mandates a compulsory notice for appearance. Despite this clear legal position, the West Bengal Police, fully aware that Surjit Dasgupta resides outside their jurisdiction, issued a notice demanding appearance within 24 hours, without providing even basic time to make travel arrangements. This was swiftly followed by a hurried move to obtain a warrant, demonstrating a “lightning speed” conspicuously absent in far graver crimes.

If the West Bengal Police were to show the same urgency in investigating rapes and crimes against women, Bengal’s daughters would be far safer today. Sadly, such efficiency seems reserved for cases that touch political nerves and involve influential individuals.

This episode is a complete mockery of the Code of Criminal Procedure, now rechristened as the Bharatiya Nyaya Sanhita (BNS). It reeks of judicial overreach and reflects the steady descent of West Bengal under Mamata Banerjee into a police state where dissent and embarrassment of the powerful are criminalised.

Equally disturbing are the larger questions this incident raises. How does an MP of a regional party command such extraordinary influence over the police apparatus? Is there more here than meets the eye? And as the Trinamool Congress increasingly blurs the lines between party, government, and police, one must ask: who is the party’s real heir - Abhishek Banerjee or Mahua Moitra?

These questions strike at the core of democratic accountability and the rule of law. They demand answers, not intimidation, procedural abuse, and the misuse of state power.
