#Odisha especially the Home Buyers must learn from this Bombay High Court's order.
Bombay High Court has asked all residents of a building, staying without OC to vacate within two weeks.
The importance of OC must be understood by the Home Buyers, the Dept. @HUDDeptOdisha the Secretary @ushapadhee1996
To gain cheap mileage with limited knowledge on the subject matter the ministers @sureshkpujari and @dr_kcmahapatra must ask their builders friend to follow the law.
If the ministers and the @CMO_Odisha@SecyChief really want to help the Home Buyers, especially the owners of old apartments, they should take steps to regularise buildings without OC.

Issue: Despite 419 registered associations, only 70 declarations have been submitted by builders.

-Builders’ reluctance to lose control over project land.
-Alleged assurances from authorities for amendments introducing “federation” models or relaxed land transfer rules.
Impact: Homebuyers are deprived of their rightful ownership of common areas and land.
✅Gap Between Form G Approvals and Land Transfers:
Issue: Of the 50 approved Form G applications, builders have not completed registration to ensure land transfers to associations, affecting thousands of apartments.
Possible Reasons:
-Lack of clarity on stamp duty for common areas/land.
-Builders’ refusal to pay stamp duty.
Impact: Homebuyers face delays in securing legal ownership, despite compliance by the Competent Authority.

Plan approving Authority: Lacks robust audits and enforcement, contributing to delays.

-The Competent Authority (BDA Secretary) has addressed multiple complaints.
-The Appellate Authority has issued orders in five appeals.
-Some cases have escalated to the High Court.
-Sale Deeds: A few sale deeds have been registered post-endorsement, a positive step.
RECOMMENDATIONS
Clarify Stamp Duty:
The government must issue clear guidelines on stamp duty for common areas/land to expedite Form G registrations.
Strengthen Enforcement:
Conduct regular audits by BDA to ensure builders comply with OC and declaration requirements.
Impose penalties for non-compliance to deter delays.
Prevent Amendments contrary to law:
Ensure no amendments (e.g., “federation” models) dilute homebuyers’ rights without transparent consultation.
Streamline Processes:
Create a dedicated task force to monitor and resolve bottlenecks in declaration submissions and land transfers.
Protect Legal Registrations:
Enforce strict compliance with legally valid sale deed registrations to safeguard homebuyers’ interests.

1) Why did it take 7 years?
2) Why the execution of @OdishaRera orders is far below the national average?
3) Why the Certificate Officers under the OPDR Act are not willing to carry out the Recoveries?
4) Why the @CMO_Odisha@HUDDeptOdisha is unwilling to provide the infrastructures and manpower to ORERA so that it can execute its own order efficiently?

5) Why the direction of the Supreme court to complete all certificate cases within 6 months is not honored in Odisha?
