BREAKING: Tomorrow North Carolina starts mailing midterm ballots — with the tracking rule still frozen.

Same Boston judge. Still no ruling.

Solicitor General John Sauer is back at the Supreme Court asking for an immediate administrative stay so those envelopes can be checked before they vanish into the system.

Ten days ago the Court already stayed her last injunction as unripe. Then USPS published the final rule. States hand over a list of who is supposed to get a federal mail ballot. Unique barcodes on the envelopes. Pieces that do not match get sent back.

She paused that too. Fourteen days. Hearing was this morning. She took it under advisement. The First Circuit has not moved.

Once those ballots hit the mailstream, they do not come back.

Alabama follows September 9. Her order runs to September 10.

They are not fighting a ban on voting by mail. They are fighting a paper trail before November 3.
