#sapsHQ [ACTING NATIONAL COMMISSIONER LT GEN DIMPANE ISSUES STATEMENT FOLLOWING ACTS OF VIOLENCE IN SOWETO AND DURBAN]
Acting National Police Commissioner Lieutenant General Puleng Dimpane has issued a stern warning to those involved in violent protests in Soweto and Durban.
This follows the torching of ten cars in Soweto and 14 in Durban during protests outside Home Affairs offices assisting asylum seekers.
Three foreign nationals have been arrested, while shops belonging to foreign nationals have also been looted amid the unrest.
The protests are linked to claims that a recent Constitutional Court ruling on asylum applications gives undocumented foreign nationals a blanket amnesty.
"The South African Police Service will not tolerate lawlessness. We will not allow violence, the torching of vehicles, destruction of property or attacks on people to continue.
Anyone who chooses to break the law will be dealt with decisively, without fear or favour.
Those behind the torching of vehicles will be pursued. Those responsible for acts of violence and destruction will be identified, investigated and, where sufficient evidence exists, arrested and brought to book.
There will be consequences for criminality. The right to raise concerns and to protest does not give anyone the right to commit crime. Legitimate grievances must be pursued through lawful and constitutional processes.," said Lt Gen Dimpane.

Assessing claims of illegal aliens is what we're saying is wrong don't get started with the unintended consequences of this rule, bazohlala kuphi? benzeni? nabobani? while waiting to be processed?
“Importantly, the Constitutional Court’s judgment does not automatically grant refugee status or permanent residence to anyone who enters South Africa, nor does it legalise unlawful migration. It simply requires that individuals claiming asylum be allowed access to the asylum determination process so that their claims can be properly assessed in terms of the law. Applications that are fraudulent, abusive, unfounded, or do not meet the requirements of the Refugees Act will still be rejected through the established legal processes.”
– Minister of Justice and Constitutional Development, Mmamoloko Kubayi, during the Inter-Ministerial Committee (IMC) on Migration media briefing.

You must be bigger than the Government of South Africa, because they just spoke on national television about the unintended consequences of this rule, which is what we're saying as SAns. We don't want them here, we really dgaf about them granted shit or being legalised.
The Court did not grant citizenship. It did not legalise anyone.
What it said is simpler than that: if you show up and ask for asylum, you cannot be turned away on a technicality before your claim is heard.
How you entered. Whether you had the right visa. Whether you took too long. Those are procedural questions. The Court said they cannot be used to block someone before their claim is even considered.
The claim still has to be decided on its merits. You can still be refused. You just have to be heard first.
That is the ruling.
