@LiveLawIndia Hopefully restructuring will bring some respite for the HBs. Many banks stopped disbursing loans citing project delays. Hopefully that will resume too. Just hope builders won't hold HBs responsible for banks refusal to disburse.

@manishanataraj We have been hearing about correction on one pretext or the other for ages. First over-supply then demo now this. Only, the correction never happens. Surveys show prices have reduced some %. But when buyers approach builder, it is nowhere. The reduction is only seen in surveys.

Additional super area offered in lieu of delay penalty. Now buyers have to pay for the additional super area and they won't get the delay penalty either. Bad faith all round.

If delay is not due to Corporate Debtor but force majeure it cannot be alleged that Corporate Debtor defaulted in delivering possession. Penalty can be imposed on allottees if they initiate fraudulent & malicious insolvency proceedings. Great! What's next!
