NG-CDF was initially introduced to decentralize development resources to the grassroots at a time when local government structures were weak. However, with the advent of devolution, we now have constitutionally established county governments with the mandate and framework to deliver services at the local level. CDF in its current form duplicates this role and undermines the devolved system.
Moreover, assigning MPs the responsibility of implementing government projects contradicts the principle of separation of powers. Parliament’s role is to legislate, represent the people, and provide oversight—not to manage funds or run development projects.
As the Bill moves to the Senate, TISA calls on Senators to reflect deeply on their constitutional duty to protect devolution. Entrenching NG-CDF in the Constitution entrenches confusion and conflict between national and county governments. It weakens accountability structures and blurs lines of responsibility.
We urge the Senate to demand a clear framework that aligns with devolution, promotes transparency, and respects institutional boundaries. Guarding devolution means rejecting structures that dilute its purpose.

Anne Amadi is a seasoned legal practitioner and former Chief Registrar of the Judiciary, with over three decades of experience in the legal and judicial sectors. She has played a central role in two presidential transitions, swearing in both Uhuru Kenyatta and William Ruto.
