To hold a government official accountable, the victim has to point to a past court decision—by the U.S. Supreme Court or the relevant federal circuit court—that ruled the exact same misconduct, under the same circumstances was unconstitutional.
If no such case exists, even if the right violation was obvious, Qualified Immunity protects the official from being held responsible.

Meet Ruth Herbel.
Elected to the Marion, Kansas city council in 2019, Ruth fought what she saw as corruption in local government. Her efforts put her in conflict with the mayor and his allies, who repeatedly tried to remove her from office.
In 2023, after a heated city council meeting, the mayor and police chief allegedly used a fabricated investigation to raid Ruth’s home.
Now, Ruth is suing with the Institute for Justice to hold city officials accountable. Her case sends a clear message: government officials cannot use criminal investigations to silence critics.
