So, how can you be lost at the same time?
My idea means that if white blunders into a forced draw before move 40 then black should be rewarded.
If the perpetual does not end in repetition till move >40 then a draw would be the result.

The best way to show that a system is broken is by taking full advantage (legally) as much as possible and therefore highlighting the obvious flaws in the system so that the authorities will be forced to fix it.
However, Hikaru might just be doing it for selfish reasons.
