Justice Mugambi Rules, Phone Data & Privacy:
1. The High Court has found that your registered mobile number is now officially part of your protected digital identity under Article 31 privacy rights, just like your national ID or passport.✅️
2. It blocks easy recycling of inactive numbers. The Attorney General has 6 months to create safeguards, your informed consent required, or public notice + proof you can't be found, plus tech to stop personal data leaks to new owners.✅️
3. This protects against privacy risks from reassigned numbers (e.g. bank OTPs, accounts). ✅️
4. This a Big win for digital rights✅️
This Lady on Tiktok cleaning her house said something that really stuck with me: “Take care of what God has already placed in your hands, so He knows you’re ready for what’s next. If you don’t steward what you have now, you can’t expect more.” And that hit. Wherever you are in life right now the small apartment, the job you’re still growing in, the season you didn’t plan for honor it. Be responsible with it. Be grateful for it. Growth starts with stewardship. 🫶🏾

YOU'RE FIRED! is a popular statement in movies that precedes employment termination. In Kenya, it's not that simple, even when the employee is within the probation period. In this Employment Law article, we highlight the legal position on terminating probationary contracts
Court of Appeal Judges Kathurima M'Inoti, Agnes Kalekye Murgo & John Mativo have ruled that Finance Act 2023 fundamentally flawed and therefore void & consequently unconstitutional.
2 key things:
· With Finance Act 2023 rendered unconstitutional, null & void, we revert to tax laws as last amended by Finance Act 2022
· I think this judgement is extremely consequential in determining how we conduct public participation on bills going forward

Justin Muturi's tenure as Attorney-General was marked by poor advice and a failure to resign when ignored, contributing to illegal and unconstitutional government actions over the past two years. Despite this, his dismissal was unconstitutional, null, and void. Let me explain :🧵
Dear Law Students,
The late Justice David Majanja made significant contributions to the cause of justice and the development of our jurisprudence. Among his many landmark decisions are the following (see link): https://t.co/BJ1DdIj9MY
1. *Crown Beverages Limited v MFI Document Solutions Ltd (2023)*
He held that statutes should be interpreted in a manner that promotes access to justice.
2. *Kenya Bus Service Ltd & Another v Minister For Transport & 2 Others (2012)*
He held that the mandatory 30-days’ notice of intention to sue the government is a violation of the right of access to justice and amounts to unjustified limitation of a right within a democratic society.
3. *Samura Engineering Ltd & Others v Kenya Revenue Authority (2012)*
He recognized that the 2010 Constitution had constitutionalized administrative actions and required that all exercise of public power be justified as being in compliance with the law.
4. *Republic v SOM (2018)*
He directed the reform of the Penal Code, given his findings that the detention of persons with mental health conditions at the pleasure of the President was unconstitutional.
