När juryn fäller – och barnperspektivet redan är borta

Juryn i Göteborgs tingsrätt har fällt Sara Nilsson för grovt förtal.
Nu återstår domarens beslut, som kommer att offentliggöras senare.
Men oavsett hur domslutet slutligen formuleras är en sak redan tydlig: barnperspektivet har lämnat rättssalen.

Bakgrunden är att sanna, dokumenterade uppgifter offentliggjordes om en vuxen man som haft sexuellt präglad kommunikation med ett konto han själv uppfattade som ett barn. Kontakten omfattade inte bara sexuella meddelanden, utan även att mannen skickade dickpics till den han trodde var en minderårig flicka. Uppgifterna var ostridiga och styrkta genom skriftlig dokumentation som också presenterades under rättegången.

Jag var kallad som vittne och satt i salen när försvaret förde sin argumentation. Linjen var konsekvent: eftersom barnet inte var verkligt, skulle beteendet inte bedömas som brottsligt. Mannen anförde dessutom att han i kommunikationen skrivit att han ville vänta tills flickan nått en viss ålder, eftersom han menade att detta då skulle vara tillåtet enligt lag.

Det resonemanget fick stort utrymme. Mycket utrymme.

Att detta över huvud taget kan framställas som relevant säger något om hur snett fokus har hamnat. I Sverige är man barn tills man fyller 18 år. Hela vår barnrätt – och hela idén om vuxenansvar – bygger på att vuxna inte ska sexualisera barn, inte skicka sexuellt material till dem och inte resonera kring gränser som om det handlade om juridiska kryphål.

Ändå kom rättegången i praktiken att handla om något helt annat. Om den vuxne mannens upplevelse av att ha fått sitt anseende skadat. Om hur hans liv påverkats. Om hans situation.

Det talades däremot mycket lite om varför samhället reagerar kraftfullt på att vuxna skickar sexuellt innehåll till personer de uppfattar som barn. Det sades inget om barns utsatthet i digitala miljöer, inget om varför grooming och sexualiserad kommunikation betraktas som skadlig, inget om de långsiktiga konsekvenserna för barn som utsätts för sådant beteende.

När juryn nu valt att fälla Sara Nilsson är signalen svår att misstolka: den som offentliggör sanna uppgifter i ett tydligt allmänintresse riskerar rättsliga konsekvenser, medan den vuxne som uppvisat ett sexuellt beteende riktat mot barn ges ett starkare skydd.

Det här är inte bara en fråga om förtal.
Det är en fråga om vilka värden som i praktiken prioriteras.

Sverige har skrivit under FN:s barnkonvention, som sedan 2020 är svensk lag. Barnets bästa ska komma i främsta rummet. Staten ska skydda barn mot sexuellt utnyttjande. Sverige är även bundet av Lanzarotekonventionen, som tydligt kräver förebyggande åtgärder och ett starkt skydd för barn, även i digitala miljöer.

När rättstillämpningen i stället landar i att vuxnas rätt till anseende väger tyngre än barns rätt till skydd, då är det inte märkligt att frågan om konventionsbrott väcks.

Även Europakonventionen gör sig påmind. Yttrandefriheten och rätten att sprida sanna uppgifter av allmänintresse finns inte till för obekväma frågor. Den finns för att möjliggöra insyn i beteenden som samhället har ett legitimt intresse av att känna till – särskilt när det handlar om barns säkerhet.

Nu väntar vi på domarens beslut.
Men redan nu är konsekvenserna tydliga.

Det här rättsläget riskerar att tysta dem som slår larm.
Det riskerar att försvåra arbetet med att skydda barn.
Och det riskerar att göra barns rättigheter till något som erkänns i teorin – men förhandlas bort i praktiken.

Domen kommer att överklagas.
Arbetet fortsätter.

För barns rätt till skydd är inte en åsikt. Det är ett ansvar!

Trots att motparten sexchattat med fiktiva Nellie och skickat bilder på sitt kön till henne, handlade dagens rättegång inte om barns bristande skydd eller vuxna som vill utnyttja barn sexuellt.

Istället handlade dagens rättegång om en fullvuxen man som riskerat att utsättas för andras missaktning då jag publicerat vad han skrivit till ett barn.

Motparten yrkade på 300 000 kronor i utebliven inkomst, 400 000 kronor i rättegångskostnader, 150 000 kronor i skadestånd dessutom sex månaders fängelse för att jag berättat vad som hänt.

I Sverige verkar sanningen vara farlig och tystnaden trygg.

Alisa shared her heart-wrenching story:

“I trusted them to take care of my baby, and they took him from me. I was hesitant about vaccines, but the doctor kept pushing, saying it was routine and safe. I didn’t know they were giving him 13 shots at once. Bently was happy and healthy that morning, smiling like always. After the appointment, he wasn’t himself - he was so fussy, wouldn’t eat, and felt hot. I called the clinic, but they told me it was normal and to give him Tylenol. That night, I checked on him, and he wasn’t breathing. I tried to wake him, screaming his name, but he was gone. My world ended. I rushed him to the hospital, but they couldn’t save him. Later, I found out through his records they gave him all those vaccines. I never would’ve agreed to that. They killed my baby, and I’ll never forgive myself for trusting them.”

Bently’s death was caused by cardiac arrest from the vaccine overload, with studies cited in the article linking such incidents to Sudden Infant Death Syndrome (SIDS), the third leading cause of infant death in the US, peaking at 2-4 months during heavy vaccination schedules.

March 1984: Time Magazine runs "Cholesterol: And Now The Bad News" with a sad face made of bacon and eggs on the cover.

The article declares total war on dietary cholesterol and saturated fat. Eggs are poison. Butter is death.

The American public freaks out and switches to margarine and egg whites overnight.

September 2014: Time Magazine runs "Eat Butter" with a photograph of a butter curl.

Thirty years later they admit they were wrong. The science never supported the cholesterol hypothesis.

Saturated fat doesn't cause heart disease. Dietary cholesterol doesn't raise blood cholesterol significantly.

But here's what happened between those covers:

Three decades of people avoiding eggs and butter.

Three decades of margarine consumption spreading trans fats through the population.

So let me get this straight. As a paramedic I could’ve told everyone they need to be vaccinated, without being a virologist. Without any push back.
But as a paramedic that’s seen vaccines harm and kill people, I can’t warn about the dangers of vaccines, because I’m not a virologist?
Nope, I won’t play that game.

Until virologists are doing the cpr on the victims, they aren’t allowed to tell me what is and isn’t safe ever again.

I have every right to speak and I would say a duty to speak on what I have witnessed. Truth doesn’t require a credential, it requires a conscience.
