Court noted that both daughters had stated during the trial that the allegations against their father were made under coercion from their mother.

The minor told the Court that she wanted to live with her father and sister, she had never been mistreated by him, and the ongoing matrimonial dispute between her parents had disrupted her studies and JEE preparation.

Even after spending 15 days in a shelter home to ensure she was free from the influence of either parent, she remained firm in her decision.

Holding that the welfare and wishes of the child were paramount, High Court found both daughters to be mature enough to make an informed choice and restored the minor's custody to her father and elder sister.
