Five years after the review of the statutory presumption of parental involvement commenced, the UK government has finally announced that the presumption will be repealed!
This is very welcome and momentous news. It is a first and very important step in ending the ordeal of all the mothers who have been through their worst nightmares trying to keep their children safe in family court proceedings. It is a validation of all the sheroes who have fought for this change for years.

The presumption should never have been enacted in the first place. It cast in stone the pro contact culture that has and continues to underpin family law proceedings in England and Wales to the huge detriment of adult and child victim/survivors of domestic and sexual abuse. It is shameful that the coalition government enacted it and a credit to the current government that they have taken this important step.

It may take some time for this vital change to enter the statute books but all courts and professionals should stop the culture of ‘contact at all costs’ right now and stop putting mothers and children at risk from abusers. The message is clear: domestic abuse is a significant failure in parenting and abusers should not benefit from harmful presumptions.
