You'd like to think that's how it should be, I've been a victim of multiple fraudulent copyright takedowns from the same individual, I counter notified every single one and the individual took no further action on any of them. YouTube have done nothing about it though. One thing I have learnt from it though is that US law on copyright is largely a problem with all this as well. If a claimant submits a copyright takedown request, YouTube must process it and provided it has all the required legal information and gives a legally valid reason for the takedown then by US law, youtube must accept the takedown regardless of merit in the reasoning because they are legally barred from acting as judge or jury on these matters. The other party can then submit a counter notification and again providing it includes all the legally information and a legally valid reason then youtube must forward this back to the claimant. The claimant must then provide evidence of court action to keep the video down otherwise youtube must reinstate the video after 10 US working days. Youtubr are not legally allowed to do anything different in that process otherwise they risk losing their safe harbor as it opens them up to potential legal action against them. I do think though when an obvious pattern starts emerging and it's clear an individual is abusing the system, they really should act on it, I mean people have been harshly terminated for really small reasons under the pretence of keeping the platform safe, yet people can go abusing the system and potential ruin people's channels with fraudulent takedowns and nothing happens to them, so youtube aren't keeping the platform safe at all.

If you believe you own the content then the best thing you can do is submit counter notifications by emailing [email protected] as you'll no longer have access to the webform. If your unsure of how to write a legally valid counter notification, just run it by ai and tell it the full circumstances of why you believe you own the right the content, and also state you have send it by email as your account is terminated after receiving 3 strikes. Then it will put together a template for you and you just need to replace a couple of parts with the actual details such as video url and your full name and address etc. Remember it's a legally binding statement so the claimant can submit court action once your counter notification is forwarded to them and they'll have 10 US days to do so before your content is reinstated. So there is that risk if your aren't prepared for court action, but it's the only way to get your channel and content reinstated.
I'll also add something doesn't seem right to me here, I'm assuming your in the ypp, therefore when you hit 3 copyright strikes you will have had a full week to dispute them before your account was terminated, why didn't you submit a counter notification before your channel was terminated if it was clear the claimant wasn't going to budge? I'm assuming it's because you don't want risk legal action, but I'm afraid it's the only option you've got, YouTube in this instance are just following the law, so the only way to reinstate yourself is by counter notifications as I explained. By all means try emailing the claimant further for retractions, but if they aren't wanting to budge then you only have the counter notification option.

@Joe2ShiestyLit I was going to ask if they'd ever got back to you regarding this. Personally I'd give them a full month, so until 4th September, as that should be more than enough time for a manual human investigation. If you still have heard nothing at that point, maybe try following up again?

@Joe2ShiestyLit Yeah, make it look like they are trying to do good by looking at things that don't matter to most of us, while allowing the AI to punish innocent creators with life time bans. I think Ai should be allowed to do temporary bans as a max. Only humans should be able to perma ban imo.

@Joe2ShiestyLit Yep I know what you are referring to, and it just seems to be a popularity contest. If you are a big creator with a huge following that causes a massive public uproar, they'll give in to peer pressure. Smaller creators don't get that, yet they claim to treat all creators equally.

@theparenttap @TeamYouTube Exactly my point, which is why if it were me I'd be wanting to know what terminated channel I supposedly own if I've violated the circumvention policy. The fact they can just terminate you and say you violated a policy, but won't say exactly how or where doesn't seem right to me.

@Joe2ShiestyLit Yeah true, still I don't believe you did anything wrong and that the bot just returned a false positive, but for whatever reason you are just being completely ignored when asking for a human review.

@Joe2ShiestyLit Oh don't even get me started with that shit. Whatever you ask just gets automated or templated replies focusing on keywords you used in your query which is completely irrelevant to what you're actually asking. Honestly the worst support I've ever had for anything in my life.

@Joe2ShiestyLit YouTube terminate channels on the pretence of keeping the platform safe, yet this guy has faced zero punishment for what he's done and he's the one making the platform unsafe. I have full evidence yet youtube ignores my requests for a human to review it.

@Joe2ShiestyLit Agreed, I mean the worst part is that termination was caused by someone else who steamed anime porn on my account at their home without my authorisation. That same person has then issued 18 false copyright strikes against my current channel and is still thriving on his channel.

@AnilR79887 @TeamYouTube How many takedown requests did you actually submit? I'm just asking because I had an individual submit a total of 18 against videos on my channel, all completely fraudulant and I successfully countered them all, yet this person never got a warning let alone a termination.

@Joe2ShiestyLit Yep that's true. I still believe with him being young that he's used other people's names and IDs that are of age, obviously one of them is linked the terminated channels, and a different name and ID is linked to the reinstated ones. Can't think how else he'd have got round it.
