@FrankieCuskey @GenLeePisthof The analogy doesn't work because a waiter has no agency in serving the food. The person who pulls the trigger has agency: he coulda checked the rounds, coulda said no I won't point a gun at someone at all, woulda coulda shoulda. And didn't. Hence criminal culpability.

He didn't mean to kill that lady...it just happened, due to his reckless disregard for gun safety. Manslaughter is a crime in which you didn't want to kill someone but did.

@FrankieCuskey He pointed a loaded gun at someone and pulled the trigger. That's why someone is dead, and why he's responsible for it. In the end, he'll get a plea deal that'll probably keep him out of prison but wipe the smugness off his mug. And that won't be a bad outcome.
