@mattyglesias IRS agents are prohibited from horse trading. Not sure if that is statutory but it is policy. This would be the biggest horse trade in history.

@kyledcheney@politico@joshgerstein I was in practice, many years ago, with the judge and I had a case front of him, which we lost. I don’t always agree with him, but he is as solid a jurist as you will find. Conservative, but fair. And he doesn’t put up with crap, even DOJ crap. Perfect for this case.
@RichardRubinDC Of course there was no ongoing audit. Why would the under staffed IRS waste time on 501(c)(3) audits of universities? Trump has violated a criminal statute but, of course, nothing will be done about it.
@mattyglesias I read Silas Marner in 10th grade and while I am generally in favor of reading classics in high school, marner bored me to tears. I later read Middlemarch and Doronda and loved them, so maybe I should give Marner another try.
@Richard_Primus I saw him live in Master Harold and the boys maybe 25 years ago. Probably the greatest acting I have ever seen. Also saw him on Broadway. If you only know him from the movies you have missed out. FYI he is Michigan grad.
@BarbMcQuade Following up, the donor should have filled a gift tax return, but he might not have owed any tax. I don’t think you can blame Thomas if the donor failed to file. The issue is factually intensive. Of course, Thomas might have had a disclosure duty.
@BarbMcQuade To be clear, loan forgiveness might be taxable income, but there are cases in which it isn’t. See IRC 108. Most likely these exceptions don’t apply. But there seems to be a strong argument that this was a gift. A gift is not income. See Diberstein for the relevant idea.
