Today, SCOTUS heard OA in Skrmetti, a blockbuster EPC case concerning TN's ban on certain forms of gender affirming care. We are hesitant to guess how this case will be decided, but we know that upholding TN’s ban would have a devastating impact on the transgender community.
Notably, several justices, including C.J. Roberts, suggested that generalist judges are not well suited to assessing the scientific and medical evidence cited in these bans - a real 180 on their Loper Bright argument, if you ask us.
