Reminder that the ECHR case law frequently cited to block the deportation of foreign criminals concerns a Sikh who, in 1996, successfully blocked his deportation back to India because the Court ruled the Hindu government would have persecuted him for pro-Khalistan beliefs.

Because of this case, Article 3, the right to be protected against torture, was declared " equally absolute in expulsion cases."

Not only is there now a statutory obligation on ECHR signatory states to "safeguard him or her [the deported criminal] against such treatment is engaged in the event of expulsion".

But also, if Article 3 is absolute, then "the activities of the individual in question, however undesirable or dangerous, cannot be a material consideration."

So, the criminal behaviour of the person being deported cannot be considered when judges decide whether a deportation appeal is legitimate or not.

Britain can't deport foreign criminals because mamaging the blood fueds of the Indian Subcontinent matter more to our politicians and judges than the safety of the British public.

Mohammed Bubacarr Jabbie from Gambia attempted to sexually abuse a 14-year-old White British girl, caught by British patriots.
