@bgarlinghouse@digitalassetbuy@CarlosMiguelC10 @cryptoguy2714 @CangaMichael It’s a fool’s errand the SEC is on. With the repeal of the Chevron doctrine, SCOTUS will reverse the SEC even if they win on appeal. So it’s clearly a delay tactic, one that will definitively make XRP and programmatic sales of crypto as ruling precedent.Gendler is simply bitter
@FilanLaw Rakoff’s “logic” is the equivalent of Miley Cyrus taping a note to her front door stating she’ll donate a $1 to ISIS every time someone watches her YouTube video and then idiotically claiming all the people watching are terrorists. Total nonsense. Yes, Rakoff. You’re an idiot.
@FilanLaw Secondly, the statement “secondary market purchasers had every bit as good a reason to believe that the defendants would take their capital and use it to generate profits on their behalf” is also blatantly FALSE. Many of these people didn’t know ripple EXISTED.
@FilanLaw The terraform decision hinges on the quote “public campaign…would presumably have reached individuals who purchased..on secondary markets”. This, in fact, CANNOT be presumed, and is false based on evidence presented in the ripple case. Rakoff made the wrong conclusion here.
@EleanorTerrett Once again, Jorge Tenreiro, the losingest SEC lawyer, weighs in to argue a losing argument. Jorge. Take the L. You lost. You’re not going to win this one. It’s over. The Terra case is a Fraud case based on a totally different set of facts. Let it go.
@SpicyKetchupMan@JoelKatz@JohnReedStark How can I re-transmit the terms when I don’t know who I’m selling to? Exchange transactions are blind. There is no transparent relationship between buyer and seller. No terms can be transmitted.
@SpicyKetchupMan@JoelKatz@JohnReedStark When I sell you a stock, I transfer a relationship with terms. If I sell you some Nike shoes, I’m not transferring a relationship between you and Nike. If Nike has a public relations issue, that may change the value of your shoes, but it doesn’t make your shoes a security.
@david_r_barrera And if you buy your shoes on an exchange and Nike is the seller, but you don’t know that, then you can’t expect anything from Nike, because you’re not buying a relationship, and you don’t have a known direct financial relationship with implied guarantees.

@CGasparino@JohnEDeaton1@JohnReedStark It doesn’t seem terribly difficult to understand. The “sophistication” of the buyer is not at issue. Programmatic sales are blind. The buyer and seller have no determinable relationship. No expectations can be obtained from the seller if the seller cannot be identified.
@blckchaindaily I love how the SEC just says “don’t follow that ruling”. Yes, don’t follow the law. Just substitute your own judgement or take the SECs word, make it up as you go along! Unbelievable disrespect for the law.
@MasonVersluis They can’t simply say “the judge got it wrong”. They need a valid underlying cause to appeal. XRP is not inherently a security. ITS THE LAW. Deal with it Gary.
@MbtHawk@thorpshannon87@Tenseiobunaka@CryptoNGold fees.I simply make the transaction internally. I would have to hedge held XRP with some instrument- insurance, etc.But I might save some money holding XRP. This means the XRP I’m holding is not available for trade on the open marketcreating scarcity and upwards price pressure.
@MbtHawk@thorpshannon87@Tenseiobunaka@CryptoNGold take some time. The question is, do these balances Im available XRP across exchanges cause significant slippage?
Secondly, if I’m transacting major amounts of XRP daily, it makes sense as an institution to simply hold a pool of XRP so that I don’t need to pay the transaction
@MbtHawk@thorpshannon87@Tenseiobunaka@CryptoNGold transaction occurs, XRP is removed from the market and is not available for purchase or sale. Also, XRP may be sold by the receiving party an entirely different exchange. There are bots that make money on the differences in price across exchanges, but these exchanges also
@MbtHawk@thorpshannon87@Tenseiobunaka@CryptoNGold an order book of XRP sales/purchases to facilitate trades. If I’m transacting a 50 million dollar trade at an exchange, meaning I buy 50 million in XRP, and then I transfer that XRP to another account, and then they sell into pesos, say, for the duration of the time that this
