And why you should be very skeptical of any video he posts.

1)

The election workers followed the law.

When O’Keefe, impersonating a registered voter, asked to vote, the poll workers repeatedly asked for his identification.

He said he didn’t have identification and asked if he could still vote.

The poll workers told him yes, he could vote, but it must be a “questioned ballot” that goes into a security envelope.

It is NOT immediately counted. I’ll get to that later.

The election workers did the right thing. They followed the law.

This “questioned ballot” is called a “provisional ballot” in most other states. Provisional ballots are required by the federal Help America Vote Act (2002) section 302.

This is done so that no voter is mistakenly turned away (disenfranchised).

It is the safety valve of in-person voting.

As mentioned, the “questioned ballot” goes into an envelope. The voter must provide identifying information on the ballot envelope and then seal the envelope.

The envelope is set aside until it is taken to a bipartisan board.

That bipartisan board uses information from the election office and from the voter to determine eligibility. If eligible, it is tabulated. If not eligible, it is kept in its sealed envelope.

This meant to preserve a voter’s right to vote, but it also protects against fraudulent vote attempts like the one O’Keefe contemplated.

O’Keefe of course knows this. Because he cites to both the state statute (15.15.215) and an August 10 social media post from the Alaska Division of Elections that includes this information.

But he ignores the information and omits it in his video.

O’Keefe did not expose an opportunity fraud. He did not expose unlawful conduct by election administrators.

He did, however, record some seemingly sweet, civically-minded older Americans working the election site who tried to help him with his alleged issue.

Those good Americans will now be seen by millions of Americans.

A handful of those viewers will harass the poll workers. One or two viewers might even make a a threat. And all the poll workers did was exactly the right thing as required by law.

While O’Keefe did not uncover unlawful conduct, he might have created unlawful conduct.

It is unlawful to be in a voting location without being a poll worker, a voter, or an otherwise-authorized person.

It is unlawful to impersonate another voter, even if you don’t actually cast a ballot. Alaska Stat. § 15.56.040(a)(1).

Fun times.

O’Keefe is doing all of this in the context of pressuring Lisa Murkowski to support the SAVE America Act.

But nothing O’Keefe did in the video would be changed as a result of the SAVE America Act.

💢 “Additional Terrorists”

An Israeli airstrike tore through a cafe on Gaza City’s shoreline Tuesday killing 7 and wounding 14. Israel claimed it “struck a meeting of Nukhba commanders, including a company commander, three platoon commanders” and “several additional terrorists.” It provided no names or evidence.

Footage of the aftermath shows women and children bleeding amid the wreckage, and at least one child among the dead. Small children’s shoes lie abandoned beside pools of blood and shattered debris. A young boy holds open a black plastic bag while a man collects pieces of human remains. Blood runs from the elevated cafe into the sea.

Israel’s military nevertheless claimed it had taken measures to protect “uninvolved civilians.”
