President Ramaphosa will sign the BELA Bill into Law September Friday the 13th. Here’s a summary of the bill:
First, the BELA Bill doesn’t touch much on issues such as schools curriculum, pass rates, subjects offered.. its primary focus is on administration and management processes in schools.
Some finer details of the amendment haven’t been clearly discussed, but here’s what we know:
- Inclusion of Grade R as compulsory schooling mandate under the SAS Act. This amendment said to relieve parents of the financial burden associated with Grade R education, particularly in no-fee schools.
- Language Policies: currently SGBs in public schools have so much power over policies such as the schools main language used. The BELA bill will transfer some of that power to the HOD ( I guess the minister of basic education). Some schools uses language of the minority learners, which is discriminatory to the majority… like what we see in most ‘Afrikaans public schools’ hence some people are angry😡. The HOD office will have to approve looking at the demographics
- Also admission into all public schools, decision making authority will be transferred to the HOD. This change was influenced by discriminatory admission practices observed in some schools.
- Will also give monitoring authority of learner’ school attendance to educators, principals, and school governing bodies, also outlining steps to be taken when a child is absent from school. Criminalise parents who keep children away from school, miximum 12 months jail time
- Prohibiting initiation practices in schools like what some schools do to Grade 8 learners. These practices said to make new learners feel uncomfortable.
- Prohibiting Corporal Punishment. Providing guidelines on how to discipline learners.
- On Home Schooling. Before a learner is registered for home schooling the department will send officials for pre registration site visit. The minister will provide other regulations on home schooling.
- The bill proposes that a code of conduct developed by a school must be sensitive to cultural beliefs and religious observances. The code of conduct must also contain a section which allows pupils to request an exemption from complying with certain parts of the code of conduct.
