Deep dive into EU Commission's pursuit of a police deal with Israel - another area where @vonderleyen's Commission has sought to cut corners on EU and international law for the sake of ties with Israel https://t.co/JooOfsBBKr
@legalstyleblog@dabrote I'm not familiar with all removal statutes, but doesn't this result in remand to state court at least under some/most removal statutes, that's what I've seen. See 28 USC 1447(c)
@legalstyleblog@dabrote Wouldn't that be constitutionally suspect and a tenth amendment issue? (Are current removal statutes based on necessary and proper relating to the power of establishing inferior courts, if no inferior court could hear it, it wouldn't be necessary and proper IMO)
@ilan_wurman@dilanesper Because the text includes discretion-granting language? What inferior officers are to be appointed which way is under the discretion of Congress. "such inferior Officers, as they think proper"
@TrueVAIndie@ClarenceMaximus@dilanesper I haven't read through all, but don't they agree with Sotomayor and Dilan on the ATS. It's the TVPA where they agree with the majority. (Personally as a non-American non-lawyer lol the dissent is right, the founding gen thought there are implied causes of action in ATS)
@nixoninexile Central bank independence is required by EU law, it's also a rare case were the guy could directly ask the CJEU to reinstate him, without going through national courts or the EC going for an infringement proceeding. E.g. thex reinstated this guy https://t.co/aZOCS6FH7m
@columba_lovetxt put on a skirt/dress. I want to be understood and to understand the other person, gendered upbringing and all that seems like an obstacle I dislike, but I understand that most ppl don't feel like that and are fine with it, and that makes me extra sad, idk weird rant
@columba_lovetxt if I ever end up in a relationship with a girl she will probably have at least some gendered interests that I dislike, obv different ppl will always have different interests but the gendered aspect makes me uneasy.... When I was little I remember crying when a female friend...
@NathanL0lz@AjayRedonkulus@anotheranzz@Eurofedmonarch Do you think a historian or political scientist could claim there was a break in the legal order in your VP scenario? I think obviously, as reconstituting Congress and the court are outside of the VPs and POTUSs power.
@NathanL0lz@AjayRedonkulus@anotheranzz@Eurofedmonarch I was referring to federal courts, as we are referring to the constitution of the federal system. I agree the legal order was radically changed, but I do not think anything happened that constituted a break as I think of it. Everything had support of president and congress...
@NathanL0lz@AjayRedonkulus@anotheranzz@Eurofedmonarch It was with Congress at least. But I would say it was with the court too, there were a few conflicts relating to some habeas corpus stuff but AFAIK everybody recognized the war was legal as a whole.
@NathanL0lz@AjayRedonkulus@anotheranzz@Eurofedmonarch Even if the new regime kept mostly similar institutions, it would be outside of the legal order. I am simply rejecting the claim that similar institutions mean same legal order.
