They were allowed to use it because they weren't a registered business. Elotes Doro contacted Shift Up because they wanted to register and make it official.

Before anyone had patented Doro, the rights belonged to the people who made Doro.

Elotes Doro was using it without their consent. At least Shift Up got permission and the rights from the original owners and obtained the license.

They let Elotes Doro operate until they became a registered official business. That's when they were denied the right to use Doro and asked to rebrand. They're not the victims here. They're lucky they didn't get shut down earlier.

The evidence is that people whose job it is to figure this out have already reached the correct conclusion.

1. There is a practical difference between Dorothy and Doro. They are different entities. It was created by THE fans that GAVE Shift Up the rights to own the character.
2. Use of licensed characters without approval by a third party (registered business, does not apply to small creators and artists, for example people selling convention merch) sets precedent and not enforcing it lets everyone knows they can use Doro however they want. Doro is not public domain
3. Does affect Shift Up's image if the character they own is potentially misused or a business using the character causes an incident because it comes off as an endorsement and therefore Shift Up ends up with the responsibility.
4. People who don't even play NIKKE, gacha games, or even hate "gooner" media that Doro originates from should be gatekept. I can't stand normies and LARPers hijacking MY culture.
