@0xE1@sakukittyyy I'm not a lawyer or practice law in any way so I can't really know for sure what the best path would be... I just know that this whole generative imagery thing is not something tested in courts very much yet, the law is not caught up yet.
@0xE1@sakukittyyy I think the only real way to have a path to having anything enforceable is to have written in law that all generative image models needs to disclose all material they used for training, and would have to endure severe punishments if the disclosure contains false information
@erock_the@sakukittyyy Also saying things that are posted publicly and people being able to use it as they please is not true. Copyright exists. There are real legal paths copyright holders can take to take down copyright infringing materials. You can't pretend this doesn't exist, it's real.
@erock_the@sakukittyyy Copyright in rulings against generative imagery trained on copyrighted material without permission is largely untested since it's very new. It's not that they wouldnt care in the courts, it's more so that there hasn't been enough time for rulings to be made to set a precedent yet
