Beijing has recently issued a “scientific report” asserting that Philippine accusations—namely, that China has transformed parts of the South China Sea into a graveyard for giant clams—are nothing more than a “malicious smear campaign.” Such a claim invites scrutiny regarding its credibility.

In evaluating this assertion, it is necessary to recall the findings of the 2016 Arbitral Tribunal constituted under Annex VII of the United Nations Convention on the Law of the Sea (UNCLOS), the award of which remains legally binding upon the parties notwithstanding repeated declarations by one party that it is “illegal, null and void.”

After examining extensive evidence—including satellite imagery, expert reports, photographs, and footage broadcast by Chinese state media itself—the Tribunal reached the following principal conclusions with respect to Scarborough Shoal:

1. Chinese fishermen, operating under the protection and at times the direct coordination of Chinese government vessels, engaged in large-scale harvesting of endangered giant clams (Tridacna gigas) through a destructive method known as “propeller chopping.” This technique involved deliberately dragging boat propellers across the reef flat to break apart coral and extract clams, causing widespread and permanent devastation to a coral reef ecosystem that had previously been among the most biodiverse in the region. Satellite imagery documented the rapid transformation of the shoal from vibrant turquoise to a scarred, gray wasteland over a period of only a few years. The Tribunal described the resulting harm as “devastating,” “severe,” and “irreparable.”

2. These activities constituted multiple breaches of China’s environmental obligations under UNCLOS, including but not limited to:
- Article 192: the general obligation to protect and preserve the marine environment;
- Article 194(5): the duty to take measures necessary to protect and preserve rare or fragile ecosystems as well as the habitat of depleted, threatened, or endangered species; and
- Article 123: the obligation to cooperate with other States bordering enclosed or semi-enclosed seas in the exercise of their rights and duties under the Convention.

The Tribunal’s precise finding in paragraph 964 of the Award is particularly instructive:
> “China’s recent large-scale harvesting of endangered giant clams and destruction of coral reef habitat through propeller chopping has caused severe and irreparable harm to the coral reef ecosystem at Scarborough Shoal.”

3. Far from preventing or restraining these harmful activities, Chinese law-enforcement vessels were found to have tolerated, facilitated, and in some instances actively shielded the perpetrators from intervention by Philippine authorities.

In light of these independently established facts and legal conclusions, the publication of a new report claiming that China has acted as the principal environmental guardian of the South China Sea must be assessed with considerable caution. The 2016 Award remains the most thorough, impartial, and evidence-based adjudication of the events at Scarborough Shoal. Subsequent efforts to recharacterise those events—whether through selective data, retrospective assertions of prior ecological degradation, or the production of elaborately illustrated studies—cannot alter the objective record.

To my Chinese friends, remember that reef remains lifeless, the clams are largely depleted, and the 2016 Arbitral Award continues to hold its ground.
