Apropos observations by Justice Dutta in EC appointments

If you look at the trajectory of SC judgements in matters of appointments:

1. CVC cannot be appointed by government
2. CBI Chief cannot be appointed by government
3. Director ED cannot be appointed by government
4. DGP cannot be appointed by (state) government
5. Tribunal members cannot be appointed by government
6. Election Commissioners cannot be appointed by government

Of course HC and SC judges are appointed exclusively by the judiciary itself.

In which other democracy is the appointing powers of a democratically elected government forced to be shared with unelected bodies like the judiciary or with people who lost the election (LOP).

What is the purpose of the elaborate election if the judiciary is then to say that the elected government cannot be trusted with appointments in high places hence others must also have a say. Does it remain a democracy where the will of the people, periodically expressed, is permanently circumscribed by an unelected body?

If a major law and order issue crops up, who is held responsible or accountable? The elected government or the CJI or the LOP? Yet, they both have role in the appointing process but no role in the accountability matrix!

An absurd result of these SC verdicts - the SC sits in judgement over the functions performed by the very people it chose to appoint ( CBI chief; CECs and ECs till new law came into effect).

On the converse, if one were to take the view the high office appointments must be made with greater consultation, then what about HC and SC judges?

If a SC judge can sit in appointment of CEC (as SC ruled) then why can't PM or LOP (for that matter) sit in appointment of a Judge?

However, when such logical questions are put to the SC where a reasoned response may not be plausible, the hammer of Article 142 or the conveniently flexible concept of 'Basic Structure' comes down!

Please make "GC protection act" to save them from "caste-discrimination" in academic institutions 🙏
