"Bandipur belongs to the tigers and elephants at night. Not to speeding vehicles."
The ~20-25 km stretch of the national highway cuts directly through its core area, home to tigers, elephants, leopards, gaurs, and many other species.
The night ban (9 PM to 6 AM on private vehicles, with limited buses) was imposed in 2009–2010 after severe roadkill problems.
March 9, 2010: Karnataka High Court delivered a detailed final judgment upholding the night ban. The court recognized the "right to life" of wildlife under Article 21 of the Constitution, noted the availability of alternative (though longer) routes, and emphasized the severe roadkill data and ecological importance of Bandipur.
August 8, 2019: Supreme Court upheld the Karnataka High Court’s 2010 ruling in petitions (including from Kerala). It reaffirmed the ban’s necessity for wildlife protection in the tiger reserve, while allowing limited night buses and suggesting alternative route development.
Core Reasoning on Wildlife Protection and Right to Life:
"Bandipur Tiger Reserve and National Park is a very important and echo sensitive wildlife habitat... Two National Highways cut through the Park... The nocturnal travel ban, which presupposes the right to life of wildlife, cannot be seen as illegitimate when there is another road to travel."
