The secondary points are why it was neither upheld or reversed, according to the court opinion. I think specificity is important here, or else it’s just a battle of rhetoric.

@Bubblebathgirl @ZoAndBehold They didn’t uphold the ban, they said it’s not their place to reverse the disciplinary action, because 1) the MT Constitution reserves that power to the legislature and 2) The Rep was asking for a disproportionate remedy to the alleged harm.
