BREAKING: The Court of Appeal has nullified the judgment of the Federal High Court in Kaduna in a suit involving former Governor Nasir El-Rufai and the Kaduna State House of Assembly, citing a breach of his right to fair hearing.
In its March 17, 2026 judgment in appeal No. CA/K/240/2024, the appellate court held that the trial court lacked jurisdiction when it proceeded on July 18, 2024, without proper service of hearing notice on El-Rufai and denied him the opportunity to respond to the respondents’ counter-affidavit.
The court consequently set aside the proceedings of July 18 and the judgment of July 30, 2024, and ordered that the case be reassigned to another judge of the Federal High Court for a fresh hearing.
El-Rufai had filed the suit in 2024, alleging denial of fair hearing by the Kaduna State House of Assembly during its investigations. However, the case was heard in his absence, and the trial court later declined jurisdiction.
The Court of Appeal ruled that there was no proof of service and emphasised that hearing notice is fundamental to jurisdiction. It also held that El-Rufai was entitled to respond to filings made against him.
The Empty Courtroom: Justice Delayed or Justice Denied? against Elrufai
Pictures of an empty court tell the real story. Despite adjourning the case for today, the Magistrate Court in Bwari did not sit, and the ICPC was nowhere to be found. Has the ICPC run away from the very court where they secured the order to detain Mallam Nasir El-Rufai? That order expires today, yet the gates of justice remain closed.
The Federal Government seems remarkably quick to throw allegations into the media, yet strangely hesitant to step into a courtroom. This preference for "trial by media" over formal prosecution raises a significant red flag: if El-Rufai is truly corrupt, why is the FG afraid to prove it before a judge? Bypassing the judiciary in favor of public character assassination is a hallmark of tyranny, not a functioning democracy. This strategy of fear suggests a government in a state of panic, targeting the one man they seem unable to control through standard political means.
By letting the detention order expire without a hearing, the state is effectively holding a citizen without valid legal backing. When state institutions like the ICPC avoid the courtrooms they initiated, it undermines the entire legal system. This isn't just about one man; it’s about whether the law applies to the government as much as it does to the people. If the evidence existed, the courtroom wouldn't be empty—it would be the scene of a trial. An empty court is the loudest admission of a weak case, as true justice is found in evidence and due process, not in headlines and tactical disappearances.

BREAKING: Former Kaduna State Governor, Nasir Ahmad El-Rufai and his family has demanded fresh N15.6 billion in damages from the ICPC, its Chairman, and other officers over his arrest, detention, and untrue public statements issued against him.
The demand follows claims by the commission that “wiretapping equipment” was discovered in El-Rufai’s residence.
In the letter dated March 4, 2026, El-Rufai’s legal team described a March 2, 2026 press statement issued by the ICPC as defamatory and misleading, insisting that it caused serious reputational damage to the former governor.
In a formal legal notice issued by his legal team, the former governor accused the commission of actions that allegedly violated his fundamental rights, make demands as follows:
- N5 billion as compensatory damages
- N5 billion as exemplary and punitive damages intended to deter similar conduct
- N5 billion as aggravated damages
- N500 million for injurious falsehood
- N100 million as cost of legal action
The total claim amounts to N15.6 billion.
El-Rufai’s lawyers gave the commission 24 hours to comply with the demands, failing which they said further legal steps would be taken.
These include filing contempt proceedings against the ICPC Chairman at the Federal High Court, accelerating the pending fundamental rights enforcement and bail applications at the FCT High Court, and initiating civil suits for malicious prosecution, false imprisonment, defamation, and abuse of office.
The legal team also threatened to report the alleged forgery of a remand order for criminal investigation, petition the FCT Judicial Service Commission for disciplinary action against the magistrate involved, and file a complaint before the African Commission on Human and Peoples’ Rights over alleged violations of his fundamental rights.
