I am shocked to hear such misinformed and blatantly partisan views on the functioning of our judiciary by a lawyer I greatly admire - TMC Rajya Sabha MP Ms. Menaka Guruswamy.
I simply do not understand this obsession with denigrating our constitutional institutions with blatant falsehoods, in the process of trying to score political brownie points with political bosses.
Menaka ji claims that the central government appoints only those judges that are aligned with their ideology.
This is simply not true.
If Ms. Guruswamy's contention is that women, SCs, STs, OBCs and religious minorities are not appointed to the higher judiciary by the present system, the Government's own data placed before Parliament conclusively disproves it.
Between 2018 and 2026, 847 High Court judges were appointed, including 130 women, 33 SCs, 17 STs, 104 OBCs and 46 persons from minority communities.

One may certainly argue that these numbers are inadequate.
But to claim that such candidates are simply 'not appointed' is totally false and misleading.
On the legal point - Obviously Ms Guruswamy knows exactly how judges are appointed in our country, and hence I worry that her statement is made knowingly with an intent to mislead the public - perhaps so that her political bosses who are embroiled in all kinds of cases for corruption are able to peddle an anti-judiciary narrative.
Does she forget that it is the Supreme Court Collegium that recommends judges for appointment and promotion and NOT the central government?
Has she forgotten that the same central government she criticises today, made an attempt to reform the Collegium system by bringing in a constitutional amendment in the form of the NJAC?
Also, I would like to respectfully remind her that the same judges AND system that she so vehemently criticises today as a Rajya Sabha MP, and who were appointed via the collegium system which the Modi government tried to reform, designated her as a senior counsel - obviously on the strength of her merit as a highly competent counsel.
So then why does she today so breathlessly criticise and humiliate those same judges, today?
The answer my friends, is blowing in the wind.

Idk about others, but from what I'm sensing in my home state, more and more people in Brahmin community WA groups are advising fellow Brahmins to ditch the BJP this time. This wasn't the case 1–2 years ago. @yadavakhilesh is likely to receive a sizeable chunk of the Brahmin vote.

On that logic, Jharkhand should be the only state to receive 24 hourelectricity coz the coal is theirs. TN and MH should receive all the development funds because they contribute the highest tax revenue. UP should receive all the tourism funds.

In the infamous Ruchika Singh case (the woman who made offensive remarks against the PM and the PM of Italy), the police registered a Zero FIR. However, the offences invoked S. 352, 353(1) & 356(1) of the BNS are non-cognizable. How can a Zero FIR be registered for NC offences?
Reservation needs reforms.
The Hon'ble Supreme Court has, in several judgments, advocated measures such as the introduction of the creamy layer principle for SC/STs and sub-categorisation to ensure that reservation reaches the most deprived.

In Vinubhai Haribhai, the SC held that a Magistrate could order further investigation after cognizance, but not after the commencement of trial.
The proviso to Section 193(9) BNSS changes this position by permitting a Magistrate to order FI even during trial U/S.175(3) BNSS.
Exactly, @abhinaymaths. It's not about removing reservation,it's about reforming it. The SC, in several judgments, has advocated introducing the creamy layer concept for SCs and STs, sub categorisation, so that the benefits reach the entire community rather than few families.
सामाजिक न्याय का अर्थ यह नहीं कि एक अन्याय की जगह दूसरा अन्याय खड़ा कर दिया जाए। संविधान का उद्देश्य संतुलन, समान अवसर और सभी नागरिकों की गरिमा की रक्षा करना है।
आरक्षण का उद्देश्य किसी वर्ग को हराना नहीं, बदले की भावना नहीं बल्कि ऐतिहासिक और सामाजिक असमानताओं को कम करना है। किसी भी नीति में ऐसा संतुलन होना चाहिए कि किसी दूसरे वर्ग में पूर्ण वंचित होने की भावना पैदा न हो।
इसीलिए मैंने हमेशा कहा है कि एक अरसे के बाद reforms जरूरी हो जाते है वो भी ऐसे कि कोई भी वर्ग हीनभावना का शिकार ना हो ।।
