Judge Raises Questions About ADOR's Evidence in Danielle Case:

"So is the issue only the music? As for the music, no evidence has been submitted showing that there was any completed recording or final product."

Defendant (Danielle's side):
"No music has ever been released."

Judge: "Weren't there KakaoTalk messages? Couldn't those be used, to some extent, in assessing the evidence the plaintiff is relying on?"

Judge: "Wait a moment. Who was actually leading the photoshoot? Danielle wouldn't have personally negotiated the contract, signed it, and stamped it herself, would she? You're assuming that other people, such as those involved or the other defendants, handled those matters. Is that correct?"

Plaintiff (ADOR): "We don't know."

Judge: "In any case, that's important if you're trying to hold those people liable. Are you saying Danielle independently went out to arrange photoshoots and pursue music projects herself? If you're relying on events before and after the alleged breach of contract, shouldn't there be more specific details? As for entering into contracts and establishing intentional or negligent liability, doesn't the burden lie with the opposing party?

Unlike a tort claim, if you're arguing that these actions caused damages, you need to specify the amount of the damages. For example, how much money was actually received, or, if that can't be determined, how much additional damage should be assessed through an expert appraisal. That requires further examination.

Otherwise, if those alleged damages are simply included within the overall amount claimed, then they may not be particularly significant when determining whether there were valid grounds for termination."
