After grossly abusing the Sedition provision of BNS against @zoo_bear last year, the same provision (Sec 152) has been wrongly invoked against @thewire_in and me by the Assam police for a factual story about the Indian military attache's comments on Op. Sindoor—a story that was widely reported in over a dozen news platforms.

The FIR—filed on the basis of a complaint by a BJP officeholder— was kept secret and we heard from well-placed sources that it was going to be used to effect a 'midnight arrest'. The Wire's counsel, Nitya Ramakrishnan, filed a writ petition and the Supreme Court today granted us protection from coercive action. It has also tagged our matter to the ongoing case challenging the constitutionality of Sec 152, BNS.

Remember, the Supreme Court (in May 2022) had restrained state governments from filing new Sedition cases under the now replaced IPC in the face of compelling evidence of its abuse. The repackaged version in the BNS is just as bad and arguably even worse, especially given the vagueness of its provisions.

A cautionary #VoteChori tale from across the border and here. In late 1976 early 1977, both India and Pakistan held elections. Pakistan batted first and Bhutto rigged the elections. The joke in Pakistan briefly was, “A message has come from Indira Gandhi, take Kashmir but give us your chief election commissioner. “ India batted second and Indira Gandhi was voted out. But in Pakistan Zia ul Haq who overthrew Bhutto, promised to hold elections in 90 days,stayed on for nearly 11 years, till his plane blew up. He hanged Bhutto in a couple of years. Indira Gandhi waited out just under three years, to return to power. From his death cell Bhutto wrote, “India is more heterogeneous than Pakistan, but it has stuck together due to the noise and chaos of its democracy”. Faith in democracy based on free and Fair elections, cannot be allowed to be eroded by an election commission in a state of brazen-faced denial.

-disqualifying a HC CJ from being elevated to the SC
-giving at tenure of 70 years to a HC CJ
-giving salary equivalent to the CJI
