This is probably the first time me or anyone in our founding team @NowPurchase is going on a rant so you can imagine the extent of the scenario. @MyIndusIndBank , which ostensibly is a business and startup-friendly bank has out of the blue threatened to levy penal interest citing various frivolous clauses. [We have never ever delayed a payment, they have more FD than the extent of loan]

After committing in our sanction letter to increase our facility limits if we raised X amount of equity. We got to work immediately, and were fortunate to be able to raise an amount of over 20X in equity funding – however, after keeping us hanging for months, IndusInd ultimately informed us that they would not be able to give us the additional limits. Although we were disappointed with their decision and our business had suffered while they kept us waiting, we took things in our stride,  and we able to find other leading banks ready and willing to work with us. However, when we informed IndusInd that we would be moving our business to another bank, their conduct left us aghast.

Out of the blue, we received a communication from them raising false and frivolous issues and claiming  that they will be levying a hefty amount of penal interest on us – what makes this even more shocking is that:

1. We have NOT defaulted on any payment EVER
2. Our ENTIRE facility was (and continues to be) 100% backed by FDs + accrued interest. IndusInd literally has NO unsecured exposure to us whatsoever – the bank admittedly owes us much more than we have drawn, and is now trying to find ridiculous ways to keep our money.
3. The grounds for penal interest are all frivolous and manufactured allegations such as X document wasn’t provided or Y consent wasn’t taken (even though we have proof that all these things were duly done and also acknowledged by the bank) – not a single issue relates to any delay or default in payment.
4. For all the time that we were banking with them, they were happy to take our FDs and enjoy float on our money – it is only after we requested closure of our account, that all these allegations were raised for the first time.

In essence, they failed to support us as a business, and even refused to provide services they had themselves sanctioned – and now faced with losing our business, they are trying every dirty and desperate trick (including raising baseless claims and threatening penal interest) to either wrongfully deprive us of our hard-earned money or arm twist us into continue banking with them. Perhaps they think that a startup like ours will not be able to withstand the pressure of a large bank.

While the legality of their actions is massively circumspect, social media is not the platform to discuss the same. As an entrepreneur, I can just say the ethics of this move left a lot to be desired. While we are ready and prepared to take them on legally if required, we are hopeful that rationality and commercial sense will ultimately prevail. We are hoping to be reach the ears of IndusInd top management and are using the power of collective reach to be heard.
