Something very concerning is happening quietly in Delaware County, New York regarding the land historically protected by conservation easements for NYC's drinking water.
NYC's Department of Environmental Protection (DEP) executed an agreement in 1997 with groups and officials in Delaware County, New York. The agreement established a framework for 155,000 acres of Upstate NY land to be put into easements that protected it from development. Why? The agreement helped the DEP circumvent a filtration system for the water collected in the region for NYC.
That agreement held up for nearly 30-years... until the end of 2025. A "Fourth Supplemental Agreement" was executed (screenshots attached below) that amended the original 1997 agreement.
Why would they want to change an agreement concerning drinking water?
As the Fourth Supplemental Agreement now outlines, the DEP can now "explore partnership opportunities on renewable energy projects" on land that was supposed to be environmentally protected by the conservation easements.
Since conservation easements are supposed to be legally binding, the DEP and Delaware County renegotiated a new agreement to open up 155,000 acres of Upstate NY land to foreign solar and wind companies.
The agreement also introduced the concept of "land swaps" that allow the DEP and municipalities to swap land to meet local "municipal utility and renewable goals."
And this is just Delaware County.
This introduces some dark and dystopian questions everyone should be asking themselves today.
- Why would NYC be willing to gamble with its own drinking water?
- Why, after 3 decades, did an agreement need "rewriting" to meet renewable energy "goals?"
- Why are conservation easements no longer legally binding in New York State... isn't this supposed to be for "green" energy?
- Why isn't every environmental NGO in New York State up in arms about opening 155,000 acres of pristine Upstate habitat up to industrial developers?
