A court that grants bail to Mallam Nasir El-Rufai with one hand and, with the other, imposes conditions so oppressive that they effectively make his release impossible has not meaningfully exercised judicial discretion. It has merely disguised a refusal of bail as a grant of bail.
That is the judicial facade at the heart of the El-Rufai case, and it is worth stating without euphemism: bail obtained on paper but foreclosed in practice is not bail at all. It is detention that has simply changed its address, from the defendant’s cell to the surety’s impossible paperwork.
The rule of law is not measured by the elegance of a court order granting liberty. It is measured by whether the person named in that order can actually walk free.
In Mallam Nasir El-Rufai’s case, that is the question that must be confronted. If the conditions attached to bail are so restrictive or practically unattainable that they keep him behind bars, then the substance of the order contradicts its form.
Until that test is met, the justification for El-Rufai’s continued confinement remains, on the law as it stands, unproven.
