EL-RUFAI’S BAIL OR RATHER 'NON-BAIL'

The truth which increasingly more Nigerians have decoded is that what Mallam Nasir El-Rufai @elrufai is going through is a political fight and persecution masqueraded as legal or accountability, and media war is major part of that war. This obviously explains why there is a relentless and resurgent battle of false narratives going on in the media.

In case many did not notice, on August 4, 2026 alone, two curious articles appeared in two different mainstream national dailes - one on Thisday's 'The Advocate' by Onikepo Braithwaite which I did a rejoinder to (published on Tuesday on Thisday) and another, an Editorial by Leadership Newspaper which Mallam Sanusi Maikudi did a rejoinder to (published yesterday on Daily Trust) - both articles dwelling on Mallam El-Rufai’s bail or rather 'non-bail' - both deliberately seeking to rewrite the truth and to distort or obfuscate the facts.

These are not a mere coincidence. They are carefully orchestrated and choreographed attacks on Mallam El-Rufai as part of the ongoing political war against him, and some section of the media is apparently and unfortunately a willing tool.

The fact is that, seeing that they have no real or strong case and evidence against him and no justification for keeping him incarcerated, they have resorted to their good old tactics of media trials and campaigns - sponsoring and planting stories in the media to distract and decieve Nigerians while they keep him unjustly incarcerated - essentially denying him bail on charges that are clearly bailable - using bail conditions that even the Nigerian Bar Association (NBA) which Onikepo Braithwaite herself is a member being a lawyer, has described as impossible. That is what I refer to as 'non-bail'.

The question is. Are conscientious Nigerians (whether you like El-Rufai or not) going to allow them to continue unchallenged? Are we going to allow them to win in the media and in the court of public opinion what they could not win in the Courts? The answer is up to us. It is El-Rufai today today, it might be any of us tomorrow.

Let me end by dropping this food for thought that I have highlighted severally in the past, which is reiterated by Mallam Sanusi Maikudi in his opinion on the Leadership Newspaper Editorial that I referenced above.

"In April 2026, the Federal High Court in Kaduna, hearing a separate ten-count ICPC corruption charge over the same general period of his governorship, granted El-Rufai bail of ₦200 million with two sureties made up of a serving traditional council elder and a propertied Kaduna resident. In May 2026, the Federal High Court in Abuja granted him ₦100 million bail in the DSS wiretapping case, with an accelerated trial timetable attached.

"Both courts, weighing the same defendant, the same public profile and much of the same prosecutorial suspicion LEADERSHIP invokes, concluded that conditional liberty was appropriate. It is only the third proceeding, the Kaduna State High Court corruption matter, where the medical evidence is contested, where bail has been consistently refused."

"If LEADERSHIP (Newspaper) genuinely wants Nigerian courts to apply, in its own words, “a consistent model” .... It should have meant pressing ICPC to explain why two of three courts hearing overlapping corruption allegations against the same defendant found bail appropriate while a third did not."

To Put It Succinctly.

Two federal high Courts (one in Abuja and one in Kaduna) handling over lapping and concurrent cases involving the same individual, Mallam Nasir El-Rufai granted him bail (never mind the impossible conditions) without considering him a flight risk but a state high court in Kaduna has repeatedly denied him bail. This, for a man who returned to the country voluntarily to answer an invitation by an anti-corruption agency. Think about it.

Conscience is an open wound which only the truth can heal. Let our conscience be our judge.

A court that grants bail to Mallam Nasir El-Rufai with one hand and, with the other, imposes conditions so oppressive that they effectively make his release impossible has not meaningfully exercised judicial discretion. It has merely disguised a refusal of bail as a grant of bail.

That is the judicial facade at the heart of the El-Rufai case, and it is worth stating without euphemism: bail obtained on paper but foreclosed in practice is not bail at all. It is detention that has simply changed its address, from the defendant’s cell to the surety’s impossible paperwork.

The rule of law is not measured by the elegance of a court order granting liberty. It is measured by whether the person named in that order can actually walk free.

In Mallam Nasir El-Rufai’s case, that is the question that must be confronted. If the conditions attached to bail are so restrictive or practically unattainable that they keep him behind bars, then the substance of the order contradicts its form.

Until that test is met, the justification for El-Rufai’s continued confinement remains, on the law as it stands, unproven.

It is easy to look the other way because he is not your headache, and perhaps because you don’t consider him a nice person.
