The Commission DID see City’s material, it rejected it.
If City were to appeal on this basis, the argument wouldn’t likely be that evidence was withheld, but that the tribunal mis‑weighed what was already before it: i.e. improper inferences, misinterpretation of regulatory obligations, and conclusions not reasonably open on the record.
That’s a very different legal question.
