Oh how tone changes after rough war
International law is not a menu from which New Delhi can selectively order. The unilateral declaration by India to place the Indus Waters Treaty (IWT) in “abeyance” - coupled with the brazen announcement of the Chenab-Beas Tunnel Link Project is a flagrant, multi-layered violation of international water law and a complete mockery of pacta sunt servanda (agreements must be kept).
Let’s tear down the legally bankrupt narratives coming out of Indian policy circles:
1. The "Abeyance" delusion. Under the Vienna Convention on the Law of Treaties (VCLT), a state cannot simply hit a "pause button" on a bilateral transboundary water treaty under the pretext of self-serving political narratives. The IWT has no provision for unilateral suspension or "abeyance." By attempting to do so, India is acting as a rogue hydraulic actor, setting a catastrophic global precedent where upper riparians can weaponize life-giving resources whenever it suits their domestic political optics.
2. The Illegality of Inter-Basin Transfer: Indian analysts themselves admit that the Chenab-Beas Link is an inter-basin transfer. Let’s be absolutely clear: The Western Rivers (Indus, Jhelum, Chenab) belong exclusively to Pakistan. The treaty explicitly prohibits India from diverting these waters outside their natural basins. Calling an illegal diversion an "engineering marvel" does not wash away the fact that it is outright hydro-theft. Doing this while claiming the treaty is "in abeyance" is a confession of guilt, not a legal defense.
3. Geography is Not "Generosity":
The recurring, fragile Indian grievance regarding the "80-20" water split is a mathematical scam. As even sane voices in the article note: India did not give water to Pakistan; geography did. The Indus basin naturally contours through Kashmir into Pakistan. To frame geographic reality as "Nehruvian generosity" or "charity" is an absurd exercise in revisionist history.
4. Weaponizing Water Under the Guise of Terror: Shifting the policy posture from "no talks" to "no water" is a dangerous escalation that violates fundamental humanitarian principles. Water security is human security. Threatening the collective survival of over 240 million people by choking downstream flows isn't "counter-terrorism" - it is collective punishment and an act of eco-aggression.
The Bottom Line: Pakistan’s restraint must not be mistaken for weakness. If India believes it can unilaterally rewrite geography and dismantle a binding international treaty without severe geopolitical, legal, and strategic blowback, it is catastrophically mistaken. You cannot build regional hegemony on the starvation of your neighbours. The IWT is etched in international law, not subject to the whims of New Delhi's political theater.
